10. The government cannot come into your home unless it has legal permission from a judge.
11. The government cannot hold you in jail for a major crime without the knowledge and approval of your fellow citizens.
12. The government cannot try a person twice for the same crime.
13. The government cannot make you incriminate yourself.
14. The government cannot take away your life, liberty, or property without following the law.
15. The government cannot take your private property from you for public use unless it pays to you what your property is worth.
16. The government cannot hold you in jail for a long time without a trial if you are accused of having broken the law.
17. The government cannot deny to you a speedy trial with a jury of your fellow citizens.
18. The government cannot keep secret from you those who will speak against you.
19. The government cannot prevent you from having your personal attorney.
20. The government cannot keep you from having other people help you defend yourself in a courtroom.
21. The government cannot keep you from having a trial decided by your fellow citizens in civil disputes and the fact-finding by the jury in those trials cannot be overturned by other courts.
22. The government cannot make people pay an unfairly high amount of money for bail while they wait for a judge or jury to hear their case.
23. The government cannot punish you for a crime in a cruel and unusual way.
24. The government cannot limit your rights to just those listed in the Bill of Rights.
25. The government cannot claim to possess more power and authority than what the Constitution permits, and all other powers not listed in the Constitution belong to the states or individuals.

all true. however, there are many thousands of people out there that believe this but still accept - some demand - other people’s money via the government, ...SS, unemployment, food stamps, all sorts of welfare type handouts etc....

#8 is wrong. Arms, even in the 1700’s, was a lot more than just guns.
Sharp sticks to merchant ships with ranks of cannons were covered by the 2A.

The Second and Tenth Amendments are the most abused rights.

However, we’ve been forced to live in an alternate reality where, having the 3rd Amendment as an outlier, the government, at almost every level, violates EVERY single one of those rights on a daily basis.

Also “bear arms” i.e. going about armed is specifically protected. The “well regulated" clause further requires the gov’t specifically acts to help insure you can wield arms effectively. A clear reading of the 2nd requires the gov’t facilitate ( never obstructing ) your efforts to improve skills, especially militia-related skills.
I believe there is far more to it than that.
A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.
The key here is "shall not be infringed." If you look up the definition of infringed:
1) to encroach upon in a way that violates law or the rights of another
The way I see it, anything the government would do that would impede citizens from owning firearms is an infringement and therefore un-Constitutional.
Merely saying they cannot take away the right to own a firearm doesn't go far enough to protect the right. By that definition the government could make it extremely difficult, costly, and time consuming to own a firearm - all while claiming they are not absolutely preventing ownership.
Anything that adds cost (taxes, background checks) is an infringement because it raises the financial bar on ownership.
Sort of... The prefatory clause gives one example of WHY the operative clause is necessary or correct. A prefatory clause doesn’t modify the operative clause in any sense.
Carrots are good for you, the right of the people to keep and bear forks shall not be infringed.
Could just as easily be broccoli, Stromboli, steak, or anything a fork might come in handy for.
A well regulated militia is one that is fully trained and has the material to do militia duties. Agreed. Considering how much crap the Feebies and other Alphabets are up to, State/local militia’s are not doing their job at all... even where they still exist.
However, note that being PART of a militia is NOT necessary to exercise your Right. The gun haters have been trying to get around that for a hundred years now.
