An Obama judge will not allow Hillary Clinton’s tweet claiming Trump colluded with Russia to be admitted as evidence in Michael Sussmann’s trial.
As previously reported, Special Prosecutor John Durham wanted to use Hillary Clinton’s tweet accusing Trump of having a secret line of communication with Russian Alfa Bank as evidence in Michael Sussmann’s trial next month.
Hillary Clinton’s 2016 campaign lawyer Michael Sussmann’s motion to dismiss Durham’s case was denied by a federal judge a couple weeks ago.
Sussmann was indicted last September for lying to the FBI.
According to the indictment, Sussmann falsely told James Baker he wasn’t doing work “for any client” when he asked for a meeting with the FBI where he presented bogus evidence the Trump Tower was secretly communicating with Kremlin-tied Alfa Bank.
The defamatory tweet is still on Twitter.

Sussman is being charged with lying to the FBI. A Twitter post from Hillary Clinton that makes no reference to Sussman doesn't seem to be evidence of anything that isn't already known.
So case law rulings going forward mean that instant messaging and emails are inadmissible should the state or prosecution be wanting to use them as evidence against you! There goes just about every case in court lately........
So why do you think Durham wants to introduce it as evidence? He must have a motive for doing.
Sussman’s lawyers are trying to use the Rules of Evidence to stem the flow of incriminating evidence into the case. The Obama-appointed judge seems to have heard the “dog whistle” and is acting accordingly.
Maybe Durham should go to the Grand Jury and secure an Indictment against the Judge as a Co-Conspirator

A chain of multiple inferences sometimes must be presented to make a criminal case. A good fefense lawyer will attack each inference individually and by whatever argument possible, the idea being that if at least one link can be broken, the whole chain fails.
You seem to have all the answers. Can you tell me why this Sussman character is not being charged with conspiracy? Durham is basically claiming he passed fabricated evidence and intentionally misled the fbi/doj to initiate an investigation of Trump.
