70,000 truck owner-operators in California may be forced to stop driving in one week due to new state law

A Supreme Court decision may force over 70,000 truck owner-operators in California to stop driving, creating another choke point in the already stressed West Coast logistics networks.

The AB5 law restricts the use of independent contractors and will soon be enforced against the trucking industry after the court declined to hear their appeal.

The California Trucking Association said in a statement that gasoline has been poured on the fire that is the ongoing supply chain crisis, and the decision by the Supreme Court could deny a judicial review of a lower court ruling.

In an end-of-term orders list released in June, the Supreme Court denied the review of the 9th Circuit’s reversal of the injunction against enforcement of the AB5, which is against the state’s trucking industry. This injunction, which has been in place for over two years, will be lifted quickly.

I see lots of ads in Cali for truck drivers to begin working for trucking companies.

Is there a reason why many of these drivers can't just go from being independent to salaried?

I am doubtful Red China will permit California politicians to do anything that will hinder the import of slave-made products into the American market.

There is too much money at risk to shut down the Red China pipeline. Red China may allow Gov. Gruesome to mess around a little but at some point they will say “Enough”.

For one thing if they’re independent they have their own equipment and need to keep up payments. Presumably they’re independent because the make enough more money to keep up the payments on their equipment

Nothing like running a real-world test scenario to prove what will happen.

A week or two of many truckers staying home for some "time with their families" will test the system. Do truckers truck or do California Democrats suck?

BTW I heard they fired the new black female gay press secretary because she didn’t know what she was doing.

So all these people Biden picked - Kamala is another - because of their gender, sexuality, race are total failures. How about that. God forbid democrats should ever pick people based on qualifications and character.

My brother in the Hollywood Knights of Columbus is a truck driver, independent.

The “mainly” trucking companies (you dont own your rig) pay sh*t (his words), more rules, and routes which takes them away from their normal routes. Plus, they sometimes deduct stupid stuff such as “overnight break time”.

From the article:

To be considered an independent contractor, there are conditions to be met. First is that the worker is free from the control and direction of the hiring entity in connection with the performance of the work, both under the contract for the performance of the work and in fact; second, it posits that the worker performs work that is outside the usual course of the hiring entity’s business; and third is that the worker is customarily engaged in an independently established trade, occupation or business that is of the same nature as the work performed.

Most legal analysis of the ruling agrees that the test sets an impossible standard for most motor carriers using the independent contractor-owner operations.

The guys have a ton of $$ invested and have built a business based on the rules in place at the time, and shouldn't have to start over at the government's whim, IMHO.
