"Public drunkenness" is an offense in many juridictions, if someone complains. If you're pickled on your porch quietly, probably nobody would say anything, as long as you go to the bathroom inside. If you're shouting at the shrubbery, a neighbor is likely to call the cops, and the cops can arrest you.

One of the more interesting subjects which came up when I was in jail was whether you can be arrested for "drunk in public" when you are on your own property. My position is that this should not be possible. I like to sit out on my front porch, have a drink or three, and study my shubbery. I am not driving or doing anything else which I consider to be wrong.

Your porch may be private property, but if you stand out there naked, you would be arrested for public exposure.

Same idea. If your drinking behavior is causing a spectacle for your neighbors or the public driving by, you could expect to be in violation of the public peace.

Jay(AP)-A Delaware County deputy says residents were unnerved by a man who was shooting a cannon-like device in his front yard and flying an American flag upside-down. Michael Marteney was arrested on a public drunkenness complaint yesterday. Marteney told authorities he just wanted attention so someone would help him with his drug problem.

I'm pretty sure that you would have to be deemed some kind of "public nuisance," for them to come and arrest you on your own property... then again, I'm not a lawyer, or cop.

The larger and way more serious issue here is of course the way alcohol has affected your life, and how it has managed to get you into the situation you find yourself in.

I think those are the answers you really need.

Please take some time to look inwards and reflect on this, and consider if it's a road you want to keep going down.

There are a lot of places, and loads of good people that can help you address your apparent need for alcohol... so I wish you all the best, and hope some of the good people here can add something useful to this.

It is my understanding that if you are in plain view outside – even if within your own yard or porch – you are “in public’ and subject to laws proscribing public drinking or drunkenness. The same would apply to laws against public nudity. If you are in plain view while setting on your porch – but you are nude – you are subject to arrest in jurisdictions with laws against public nudity.

My understanding is a cop can arrest you for public drunkeness if they detect any booze in your system.

Of course you won't be convicted of anything unless you were truely 'faced. Even then they should just let you sleep it off unless you give them trouble.

Cops have lots of discretion. They can arrest you in a bar if you have been drinking at all. They just don't, why would they.

The only public drunkeness arrests I've even witnessed was when someone was a danger to themselves (passed out covered in puke in the bed of their truck when the temp was heading for freezing, luckey he did'nt go for DUI) or causing all sorts of trouble.

For the record I 'marked' all four courners of my property the first night here. Two of the corners are on the yellow line of the street, it was at 3am so no arrests.

It depends on the laws where you live. Some places it is an arrestable offense. But, the cops usually don't enforce it unless there are neighborhood complaints and such.

I suppose it all depends on what you're doing on your own property. You can do stuff on your own property that creates a public nuisance, this is especially true if you have a balcony that overlooks a crowded street. Private property can be a public place for many legal definitions depending on the lay out of the property and the actions being done on it.

Once there was an alcoholic lost in the desert. He was in real trouble, dying of thirst and exposure. Just as he was about to give up hope, he stumbled across a genie's lamp. He picked up the lamp and rubbed it. Out popped a genie who said "Looks like you could use a little help. Today's your lucky day! I'll grant you two wishes."

The alcoholic looks around at the blazing sand, licks his lips and says "I want a magic bottle of vodka that's always ice cold, and no matter how much I drink, it will fill itself back up again".

Genie says "Done!" as the bottle appears before him. The alcoholic cracks the top and chugs half the bottle, then watches as the level rises back up to the top. Wow, he thinks. This is great.

"And for your last wish?" the genie asks.

The alcoholic replies "I'll have another bottle just like the first!"
