Man in custody after beating robber with brick (self defense no defense?)

CORTLAND COUNTY, N.Y. -- A Cortland man is in custody after police say he beat a man that had broken into his apartment. Police say Robbin Brill, 50, returned home Sunday evening and found a man inside attempting to steal money.
They say Brill confronted the man and then beat him with his fists and a brick. Brill then called 911, and the man was taken to University Hospital where he is in critical condition.
Brill has been charged with assault in the second degree and criminal possession of a weapon. He was sent to the Cortland County Jail and has since posted bail.

Maybe there's more to this story but as written, this sounds like a miscarriage of justice. As written it sounds like someone broke in Brill's home to rob him, he fought back and now the real criminal is being treated like a victim while the victim is being treated like a criminal.
I wonder what the party affiliation of the Cortland County District Attorney is?

Who knew a brick was an unlawful weapon? Should have used a kitchen knife. One other detail, never leave the perp alive. Deadmen tell no tales, or so say the pirates. Arrgh!

I’ve been told by Cops, if you ever find yourself in this situation, and the perp is physically in your home, do not leave them injured, and alive. then, your story is the only story. The Navy SEALs are learning this now. No more terrorists will be brought in alive.

Yeah, the story is pretty sparse on facts. I’d guess a miscarriage of justice, or he beat the guy past the point of reasonableness. The guy’s unconscious and Brill kept beating him with a brick.
Personally, I believe that if you break into someone’s house, whatever happens to you is tough shitski for you.
