The sexual assault of an 11 year old, as horrific as it is, is most certainly not identical to the rape of a 2 year old.
I also wonder why he was apparently out on parole a couple of yeatrs after the original crime.

In many jurisdictions, rape of a child under (10, 12 or 14) is treated as a capital crime. He should have been charged with attempted murder instead of a weak assault charge.
A short probation for any of these crimes is itself criminal.
