Even if both of Senator Ted Cruzâs parents were American born, it still wouldnât matter. He was born in Canada. Period. His parents werenât there because they needed to be. They were there because they wanted to be. Ted Cruz, by the letter and spirit of the law, cannot be president! p>The problem for Ted Cruz is that we know what the spirit and letter of the law says. It says if you want to be an American president, you have to be born on United States territory just like every other man whoâs ever held the office was born in the contiguous United States and Hawaii.
But thereâs more! This may put to rest any chance Ted Cruz has to somehow convince us heâs not really Canadian, and should be allowed to be president. Some have tried to argue that although Cruzâs parents were in Canada when he was born, they were still U.S. citizens. I guess they want us to see it as an extended work vacation of some sort.
Unfortunately, hereâs the problem. According to a new report released by Canadian authorities, Cruzâs mother not only lived in Canada, but she was enrolled as a voter.
In a document uncovered by âTalking Points Memoâ and published by Breitbart News, Ted Cruzâs parents were officially named on a Calgary list of electors for Canadaâs federal election in July 8, 1974. They are listed as residents of 920 Riverdale Avenue, Calgary, Alberta who are eligible to vote. And hereâs the clincher, only Canadian Citizens are allowed to vote in Canada. Thatâs right, Canadian law restricts federal voting rights to only Canadian citizens. Itâs pretty simple, if Eleanor and Rafael Cruz were eligible to vote according to the Canadian election board, that means they were Canadian citizens.

Let's see what the law says.
And the children of citizens of the United States that may be born beyond Sea, or out of the limits of the United States, shall be considered as natural born Citizens: Provided ... [conditional not relevant for this argument]That is not a definition or an equivalence, even in plain usage. In fact, it is opposite. The thing described is not, by ordinary definition, the thing named, but for purposes of law we will pretend so. The language creates a legal fiction.

I'll save you the trouble. he was born in Canada where he gained Candian citizenship by virtue of being born in Canada.
Except that Cruz's mom stayed on in Canada for a few years after the divorce.
Accept it. The more we learn, the worse it looks for Cruz. If Cruz's situation were to be okay, we'd be opening ourselves to a whole lot of people without allegiance to the US being eligible, because of their circumstance being like Cruz's.
What a shame he gave up his Canadian citizenship. Perhaps Cruz would've been eligible for highest office there.
Before you waste nay time doing the research, I'll answer it for you. They have no standing. More importantly, the U.S. Constitution gives no role to Federal courts in a case involving a constitutional interpretation in a presidential election. If a candidate is ineligible to serve, the recourse is for the Electoral College to refuse to seat him. The authority to deal with disputed elections ultimately rests with Congress, not the Federal courts.

Secondly, I fail to see where Trump or any of the others are wrong. I think even Tribe is saying here, that the matter is not resolved. If you’re an originalist, as Cruz is, then he is NOT eligible, if you are a living constitutionalist... he probably is eligible.
BOTTOM LINE, contrary to what Judge Napolitano says, it is NOT settled.
It happens to be the standard in America... and in Canada....where Ted Cruz was born.
Cruz will move for dismissal on standing, justicability and ripeness grounds. It is Cruz who controls whether or not the case is decided on the merits. He does not want a decision on the merits. He will lose, or the court will again subvert the constitution.
I feel like I want to like Ted Cruz but he has really put us in a dilemma here by refusing to face facts. He’s not stupid. he has to know what he’s doing.
I have a simple solution. Don’t allow pregnant women out of the country!

All the DNC has to do is threaten to sue on this subject and it could strongly affect the outcome in the general election.
This is a needless argument we are having and it will not go away. It will be argued, contested and litigated without end. This is a trap, set by who?; but it is a trap.
Consider this: The Constitution says “natural born citizen”. Period. That phrase has been under attack as much as “A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.”
Now consider: A defense of “natural born citizen” for John McCain, Mitt Romney and now, Ted Cruz had to be made. I won’t even mention the half breed who has no valid proof. What is happening here is a deliberate attempt to undermine the Constitution and pave the way for someone who has no right to be President.
Cruz should do what is right for the country, not his ego. And Trump should back off. Stick to the issues that have dominated the campaign: illegal immigration, jobs, taxes. That’s a winner; this trap is not.
She was married, working, and raising her family in Canada. That’s not a vacation or any kind of temporary circumstance. She made a choice.

Honestly, I think it’s just some Americans that are bringing it up and they’re bringing it up because they see it as being a threat as you have just suggested. It’s beyond Ted Cruz and Donald Trump.
