With Gorsuch’s Vote, Supreme Court Allows Arkansas to Execute Ledell Lee
Slate ^ | April 21, 2017 | Mark Joseph Stern

On Thursday night, Arkansas executed Ledell Lee—the state’s first execution in 12 years. Lee is one of eight men whom Arkansas originally planned to kill over 11 days before one drug in the three-drug lethal injection cocktail expires. Four of these men have received stays of execution, but Lee’s final plea to the U.S. Supreme Court was rejected by a 5–4 vote. Justice Neil Gorsuch cast the deciding vote allowing Lee to die. It was his first vote cast as a justice of the court.

Kill vs. Execute issue mainly comes from peoples understanding of the Old Testament.

“Thou shall not kill” confuses many.

In the original language (Hebrew) this was meant murder not kill.

It was murder that God was condemning.

Now when you apply this to hunting, wartime killing, executions. The term kill make more sense.

It is killing, just not murder.

Well it means “Thou shalt do no murder” - murder is malice aforethought meaning a planned killing of one human by another. God gave us laws and justice for us to carry it out legally in due process; some guy, like this one, went into a home and beat a woman senseless then strangled her. That was murder. His execution was not.

Well, there is no humane way to kill someone if all errors must be eliminated. But I’ve got no problem with your proposed solution.

You can bet some lawyers will, though, because what they really object to is the possibility of punishment.

Nitrogen narcosis is painless. Death is as violent as going to sleep and never waking up.

The atmosphere is majority nitrogen. You can buy a nitrogen distiller from China for about 1k and make as much as you want.

"Tie decisions mean the lower court’s decision holds. It means no executions would have occurred."

He was petitioning the USSC for a stay. He lost in the lower courts. A tie means no stay and the execution goes forward.

In that case, sounds like all the death penalty states need one!

Due process. The SC reviews the case to see if any errors were made in the trial or appeals process. They don’t judge the facts of the case.

“Your honor, my client requests a stay of execution, until we have received the requested independent test reports proving that this Chinese distiller will produce nitrogen at the purity the state requires. Also we request a stay pending import/export compliance reports on the manufacturer as well as its seventeen suppliers. Upon conclusion of these investigations, we will of course need twelve years of animal testing (to begin once the PETA lawsuits are concluded).”

Due process.

How much do they need? You look at executions in the U.S. in the 1800s, they be convicted and then executed two months later. Look at the Lincoln assassination... Lincoln was killed on April 14, 1865, and all of Booth's co-conspirators were hanged on July 7 of the same year after their arrest, trial and sentencing.

Well into the 20th century, it still only seemed to take a year. So what's with the current 'decades on death row' crap we see today?
