The Hennepin County Attorney's Office confirms prosecutors will seek the maximum sentence for the suspect alleged to have thrown a 5-year-old boy over the railing of a third-story balcony at Mall of America last month.
Emmanuel Deshawn Aranda has been charged with first-degree premeditated attempt to commit murder.
On Thursday, the county attorney's office confirmed they have filed an upward departure in the case, meaning they will seek the maximum sentence of 20 years (240 months) in prison.
Last week, a family spokesperson said the boy is now out of critical condition, and is alert and conscious. The family hopes he will be able to return home by June.
According to the criminal complaint, Aranda told authorities he "had formed a plan to kill someone at the Mall" the day before, and had come to the mall with the intent of carrying that plan out, but it did not "work out." He allegedly said he "planned to kill an adult, because they usually stand near the balcony, but he chose the victim instead."
He is due back in court next Tuesday.
He is now qualified for at least a city council seat in any of the major sanctuary cities...
