Darn! Here is another company I can’t cross off my patronage list because I’ve never gone there. But now, I will redouble my efforts to never go there.
It will be very interesting to see what the DOJ and courts do when we suddenly have businesses all over the country able to require some kind of health test in order for a person to be admitted to their business. It won't take long before people will be claiming discrimination because of the lesser vaccination rate of some group will cause a disparate impact on that group.
I think discrimination based on vaccine status has no legitimate basis, since unvaccinated people should not present much of a risk to vaccinated people, and in fact the reverse is true since vaccinated people are more likely to have asymptomatic infections.
Denying service to people based on a test which has no actual purpose is a classic example of discrimination.
FYI I just learned that this does not apply to Shake Shack restaurants.
