I believe that if you rob people with your finger in your pocket, it counts as armed robbery. Because the victims don’t know.

This is called neutralizing the threat.
When a man enters a restaurant threatening to shoot anybody who doesn’t hand everything over, he gets NO assumption of good will, and EVERY assumption of violent intent.
That means:
Likelihood of a hidden accomplice
Real possibility of a second weapon
Assumption that he will spend his last breath trying to pull you down by the ankle or grab your weapon.
The defender (he is not “the shooter”, as his primary purpose is to stop the threat. The fact that he used his best means to do so is an accidental property of same.) did not ask to be put into a situation where the adrenaline flows, survival instinct kicks in, and the brain functions differently with only seconds to act. This is not a trained soldier or policeman, just an upright civilian placed in harm’s way who did what he had to in order to remove the threat.
I would be glad to charge the armed robber with felony murder . . . his own.
Don't threaten people with a weapon or a fake firearm unless you are ready to deal with what can happen next.

I do wonder if this man will be charged. They could use the “he was leaving” and “in the back” reasoning.
BUT, he still wasn’t out of the store. It’s possible the thug could’ve turned around or continued his circuit to get more money and maybe hurt someone.
Maybe if the asshole had been made to do his 15 years, not been paroled early, and hadn’t been out on bond after assaulting his girlfriend in December, he wouldn’t have been in that restaurant to victimize anyone else that day.

Fake gun means nothing. If it looks even remotely like a rear firearm it’s reasonable for a person to be in serious fear.
