An appeals court upheld the disorderly conduct convictions Friday of actor Jussie Smollett, who was accused of staging a racist, homophobic attack against himself in 2019 and then lying about it to Chicago police.
Smollett, who appeared in the TV show “Empire,” challenged the role of a special prosecutor, jury selection, evidence and many other aspects of the case. But all were turned aside in a 2-1 opinion from the Illinois Appellate Court.
Smollett had reported to police that he was the victim of a racist and homophobic attack by two men wearing ski masks. The manhunt for the attackers soon turned into an investigation of Smollett himself, leading to his arrest on charges he had orchestrated the attack.
Authorities said he paid two men whom he knew from work on “Empire.”
A jury convicted Smollett in 2021 on five felony counts of disorderly conduct, a charge that can be filed in Illinois when a person lies to police.
He now will have to finish a 150-day stint in jail that was part of his sentence. Smollett spent just six days in jail while his appeal was pending.

“””The staging of the hate crime could be excused. The fact that it was executed so stupidly is what’s unforgivable.”””
From the beginning that has been my big interest, I want to see a mental evaluation of his stupidity and delusions, he must be a very bizarre person.
"Unless the Supreme Court reverses the appeals court ruling, Smollett must complete the 150-day jail sentence handed down in 2022. He spent only six days behind bars before he was released while he appealed his conviction."
This guy is the poster child for a hate crime hoax. He deserved to be slammed hard.
He has rich and powerful backers doing everything to keep him out of jail so he can give a middle finger to his critics.
Appellate Justice Freddrenna Lyle would have thrown out the convictions. She said it was “fundamentally unfair” to appoint a special prosecutor and charge Smollett when he had already performed community service as part of a 2019 deal with Cook County prosecutors to close the case.
i’m sure he’ll be popular...

Nice butt. That's what they'll say.
Ken Kessler:
I beg your pardon?
Barbara:
Nice butt. That's what they'll say on your first day, in the men's club.
Ken Kessler:
The men's club?
Barbara:
Mmm. The San Quentin Country Club. With a cute little rear end like that, you'll be the belle of the ball. Your dance card'll be filled every day. You'll be so popular, making all kinds of new, close friends. Big, ugly, hairy friends! Not that you'll ever see what they look like, 'cause you'll be facing the other way.
Ken Kessler:
You're very good at this. You should write children's books.

LOLOL!!!
I watched that for the first time in years, so hillarious still, and they sure can’t make it today.

Update:
Special prosecutor, Dan Webb, tells TMZ ... “The appellate court ruled on every issue Mr. Smollett raised in our favor and against him. This was a resounding and profound victory for us today. Having a dissenting voice in the ruling is not uncommon. The decision by the appeals court is final.”
He concluded, “What happens next is Mr. Smollett can file a petition for a higher appeal to The Illinois Supreme Court. This is purely discretionary meaning the court does not have to hear this appeal. He lost all legal rights to an appeal with today’s decision. If the Supreme Court decides to hear his appeal, there will be briefs filed and a hearing date set. If not, then the case goes back to the trial court, which will execute his sentence.”

They’ll end up saying that he won’t be safe in jail, so they’ll suggest house arrest instead.
