Biden DHS asks Supreme Court to let border agents cut Texas's razor-wire fence

Under Texas GOP Gov. Greg Abbott, the Lone Star State has conducted its own efforts to independently combat illegal entry into the U.S., and recently made illegal entry into Texas a state crime.

The Department of Homeland Security on Tuesday asked the Supreme Court to permit it to cut a razor-wire fence the state of Texas placed along the Mexican border.

The government has argued that the fence interferes with federal border enforcement activities and that the fence presents a safety risk to illegal immigrants crossing the border through the Rio Grande river, the Washington Times reported. The 5th Circuit Court of Appeals sided with Texas and ordered that that DHS not cut the fence except in the event of a medical emergency.

The 110-mile fence is made of concertina wire placed on the riverbank and runs through state and private property.

U.S. Solicitor General Elizabeth Prelogar, in the filing, urged the Supreme Court to permit DHS to cut the fence, arguing that "[u]nder the Supremacy Clause, state law cannot be applied to restrain those federal agents from carrying out their federally authorized activities."

The legal battle is part of an ongoing spat between Texas state officials and federal border enforcement amid an unprecedented surge in illegal border crossings. Under Texas GOP Gov. Conservatives need to fight back the same way the left fights. Make any fence cutters experience the Jan 6 prisoner experience on steroids. Arrest them and throw them in a cell with the worst of the worst. If they resist, the Texas LEO know what to do.

Upside-down world. What about the risk to legal American citizens that these invaders pose? DHS doesn't care. Who's homeland are they trying to secure?

This is America. The SC shouldn’t have the authority to give the Feds the permission to attack Texas and turn it over to Lopez-Obrador. Time to run the “border patrol” out. They aren’t doing the jobs they were hired to do. They couldn’t beat the illegal aliens so they’ve joined them.

The Department of Homeland Security is the most mis-named agency in the U.S. Government. It should be called, America’s Welcome Wagon to Invading Foreigners.

My husband’s brother worked for Border Patrol when he lived in Texas. GWB was President. They were not allowed to take action that would harm the illegals. They couldn’t use deadly force. They were told to stand down. He eventually quit. Most Border Patrol agents would love to be allowed to do their jobs according to him, back then anyway.
