A Manhattan judge has ruled that legendary Eagles singer Don Henley can be questioned over an incident in 1980 in which a 16-year-old prostitute suffered a drug overdose in his Los Angeles home.

The musician, 76, has accused memorabilia dealer Glenn Horowitz, Craig Inciardi and Edward Kosinski of stealing handwritten notes and lyrics for the Eagles' blockbuster 1976 album Hotel California.

All three have been accused of trying to sell the materials, worth more than $1million, and lying to auction houses, prospective buyers and cops about how they obtained them between March 2012 and December 2016.

Horowitz, 68, of Manhattan; Inciardi, 59 of Brooklyn, and Kosinski, 61, of Franklin Lakes, New Jersey, pleaded not guilty to conspiracy and criminal possession charges, and Horowitz to an extra charge of hindering prosecution.

Attorneys for Kosinski will introduce a statement from 1981, seen by DailyMail.com, written and signed by singer Henley in which he admits to trying to have sex with the underage girl and that he shared cocaine with her before she overdosed.

Henley was arrested on November 21, 1980 after an ambulance was called to his home when a 16-year-old sex worker overdosed at his Los Angeles property.

He told a Santa Monica probation officer he was depressed as he had separated from a long term girlfriend, was involved in a jet crash near Colorado and 'despondent about waking up every morning, not knowing if my group, the Eagles, had broken up or not'.

The rock star said he called up a 'Madam' who he claims appeared to be 19 or 20 years old and he shared some cocaine with her.

'She told me that she was only a temporary call-girl until she paid off a $2000 cocaine debt in San Diego,' Henley wrote in the statement.

OD has had different definitions — fatal or not — over time and depending who you ask.

The girl did go into convulsions and hyperthermia and death can follow that easily but didn’t.

Like you, I think of OD like drowning or electrocution. You’re dead.

From what I see online, electrocution means injury by electricity as well as death.

have had to place his trust
into believing what the
Madame had to supply was
vetted to be of legal
age to engage in such
activities (illegal as they
may be).
And, I greatly prefer Eagles’
music over the Beatles any
day of the week.
Had a friend convicted of
statutory rape. The cops
caught them in the act in
the parking lot at a bar.
(not that this is an accepted
practice).
The bartender accepted her
false ID of her being 21.

LOL....you are absolutely insanely stupid.

To ignore their impact on rock/pop, culture, technology in the studio and their massive catalogue over 5-6 years is sheer stupidity.

The eagles went from a pleasing SoCal country-pop group to a slickly produced sound with only a few memorable songs in their small and very limited catalogue. In fact, JD Souther wrote/co-wrote their better songs.

Finally, John Lennon was a far better rock singer than Henley.

Well, that’s quite charming. I can feel the love.

So? I never mentioned the writing; just the two groups’ final products. and my favorite Eagles songs were the ones where Souther was involved — Souther/Frey really.

So? As I said above, I was commenting about both groupS. Not the writing. Not a particular singer. I’m not a fan of Henley’s voice; he strains when he sings. Glenn Frey was my favorite. John Lennon ... common.

My major in college was Music. Of course, college was seminary, and the music was Church Music, so we never got into Eagles vs Beatles, although the Beatles had been around for a few years by that time. Eagles ... I don’t think so.

btw, I spent a few years on the pro-side providing tech assistance in remastering classic & iconic albums receiving credits on the albums.

I’ve been gifted many albums (hundreds of ‘dry” tracks) copied/burned direct from the raw master studio tapes before the dreaded reverb was added to the commercial release. Additionally, the mastering engineer I provided tech assistance was invited to Abbey Road to finalize a deal to remaster the entire Beatles catalogue. While there, he received direct copies of their albums and unreleased studio demos that he also gifted me.

In that music industry setting, the Beatles were always regarded as being far superior to Eagles in all areas - from songwriting, to studio recording technology to changing pop/rock culture.

The eagles, after their SoCal country-rock era, was just a slickly produced band with a catalogue of “same old, same old” songs that never showed musical or intellectual growth.

To believe the Beatles was a fad and the eagles far superior is just...well...insane stupidity lacking a grasp on reality.
