Republicans Distort Facts on Special Counsel Decision Not to Charge Biden

At their weekly news conference, several Republican House leaders wrongly claimed the special counsel report into Joe Biden’s handling of classified documents found the president was mentally unfit to stand trial. The report said no such thing.

Special Counsel Robert Hur’s report ultimately concluded “the evidence is not sufficient to convict” Biden and that “no criminal charges are warranted.”

The report did refer numerous times to what it characterized as Biden’s “limited” and “poor” memory. Those observations were included, Hur wrote, because they factored into his decision about whether he could convince a jury that Biden had acted “willfully” to break the law. And the special counsel wrote that Biden’s age and memory might make him a more sympathetic witness, causing a jury to give him the benefit of the doubt.

“We have also considered that, at trial, Mr. Biden would likely present himself to a jury, as he did during our interview of him, as a sympathetic, well-meaning, elderly man with a poor memory,” the report said. “Based on our direct interactions with and observations of him, he is someone for whom many jurors will want to identify reasonable doubt. It would be difficult to convince a jury that they should convict him – by then a former president well into his eighties – of a serious felony that requires a mental state of willfulness.”

But Hur never said Biden was mentally unfit to stand trial, a determination that requires a competency evaluation and that would not preclude a prosecutor from filing charges.

“The standard for competence to stand trial demands some recollection of events but looks as much to a defendant’s ability to consult with counsel and to understand the proceedings,” Daniel Richman, a former federal prosecutor who is now a law professor at Columbia Law School, told...

Notice that the administration is not fast tracking the release of the 5 hour video of Hur examining Biden, nor the transcript of that interview.

So why is FACK CHECK so worried about what Hur said?

They cannot say what HUr did not say. Without the transcript They can only opine on what Hur said, and they have their facts wrong.

FACK CHECK IS FACKED.

The problem the deep state had with the Biden classified documents situation was how to get Joe off without screwing up the case against Trump. Well, Joe is off the hook and with the lying and obfuscation by the WH and the lefty propaganda agencies (MSM), this will all fade away for Joe. For Trump their attack will proceed unless Trump wishes to bend to their will or plead diminished capacity. The fix was in from the start, just like the rest of the cases.

Interpretation: The DOJ prosecutor would lose at the Grand Jury stage.
IN this case, even if Joe WAS a ham sandwich (there is some debate over whether he currently IS a ham sandwich), if Joe WAS a ham sandwich, the Fed Grand Jury would not agree to any charges.

The Feds don’t like losing high profile cases in front of a Grand Jury.
Besides, his statement poisoned the jury pool.

The other part to this not mentioned is the steep hurdle to convince a Democrat DC Jury. The federal judicial capital needs to be a defacto revolving area that more closely represents American demographics as a whole. Whereas we the people, through jury, are represented within the judicial branch, we are devoid of being able to hold democrats in DC responsible for their crimes under its solid democratgraphics.

I’m just an ordinary elder citizen, but it doesn’t take a genius to see that Biden is not fit for this job. Not wanting to insult his memory or inability to organize his thoughts, but he is just not(and never has been) the man for the job. Then again, I’m not at all sure that he is the real brains behind the whole operation either. If he was really trying to serve his country, I don’t see how he could be. Same be said for whoever is REALLY behind this whole operation as well.

Well he did. He found evidence that he illegally had classified information. He didn’t even bother to look at the stuff Biden lawyers were allowed to collect, so we don’t know the damage. Mostly, he didn’t file charges, and he should have. The family knew and assisted and profited. Espionage should have been the charge.

Yeah this is definitely splitting hairs. I suspect that Hur had orders to not declare Biden was chargeable. Biden was found to be blatantly doing illegal acts, so Hur said that he would not be charged in terms that most of the public would interpret as non-compos mentis, or mentally incompetent to stand trial. Normally when this is determined informally by a prosecutor, the accused is already not in a position to commit further crimes (e.g. hospice care).

Republicans are rightfully crying foul as how can someone be both incompetent to stand trial and competent to carry out the duties of President?
