Sen. Bernie Sanders (I-Vt.) said Thursday it would be an outrage if President-elect Donald Trump followed through with threats to prosecute Hillary Clinton over her use of a private email server as secretary of state.
It would be almost beyond comprehension to think that a new president would be involved in the prosecution of his opponent who ended up getting some 2 million more votes than he did, Sanders told reporters at a Christian Science Monitor breakfast.
It would completely divide this country. It would be an outrage, he said. I would hope very, very, very much that Mr. Trump understands that is not something he should do.
Trump regularly attacked Clinton on the campaign trail for the FBI probe into her email use, vowing during the second presidential debate that he would instruct his attorney general to investigate her over it. The FBI concluded there was no intentional wrongdoing and recommended no criminal charges, but that didnt stop Trumps criticisms.
Rudy Giuliani, whose name has been floated for a potential attorney general or secretary of state under Trump, suggested as recently as this week that the president-elect still might take legal action against Clinton....

FBI would do the investigation
An unbiased Department of Justice could indict and/or prosecute based on the investigative information
Congress could conduct an investigation, but not prosecute; however it could refer to the Dept. of Justice for prosecution.
The outrage would be giving her a pass as GWB did for the Clintons. It would perpetuate the message that we have a banana republic.

Presidents are not prosecutors silly Sanders. Rather he should do the same thing Obama should have done, appoint a special independent prosecutor.
The question is, who will be in charge of the FBI. If it is Comey, it will be just another fiasco.
Not prosecuting her is a slap in the face to every other Federal employee who handles classified info.
Trump cannot uphold such a double-standard.

Could it be that an investigation of Hillary could expose Bernie of a heretofore unknown criminal act?
Seeing as how President Trump is not a prosecutor, you won’t have to worry about that, Mr. Burnme.
An Outrage? Yeah I can see that. The President was elected to deal with much larger things. Prosecuting Clinton should be left to a federal prosecutor.
I would neither prosecute nor pardon her. leave her out there hanging.
she is powerless with an investigation/indictment hanging over her.
