President Donald Trump's actions during the campaign -- possible conspiracy to accept help from a foreign national and to violate campaign-finance laws in order to hide two alleged extramarital affairs -- as well as his actions once he became president (e.g. possible obstruction of justice, witness-tampering) are at issue for special counsel Robert Mueller and for Congress in the context of impeachment.

For now, let's assume that Trump did nothing wrong during his presidency, that only his pre-election conduct is at issue. Most commentators have taken the view that Mueller cannot indict for criminal activity during Trump's presidency, although this is a matter of current Justice Department policy and not airtight law.

We've never been confronted with the situation where the means by which a candidate got elected allegedly violated the law. When he should arguably have never gotten to the presidency to enjoy temporary immunity, must the prosecutor refrain from criminal indictment? There is no definite answer. One could look at pre-election criminal conduct as no different from criminal conduct during the presidency (i.e., no indictment), or one could look at the pre-election conduct as a fraud on the electorate. In the latter case, one could argue that the president cannot use his ill-gotten gain (the presidency) as a shield to immediate prosecution.

To take this question to the extreme, what if a candidate killed his opponent?

If this author knew what the hell they were talking about or had any verified evidence of wrong doing they would not have to use the word, “if” in the title.

Her suggestion/comment that the DOJ policies now in place regarding indictment of a sitting president are basically new and temporary is pure bullshit. As Mark Levin noted, one was from about 1973 and the other 2002.

If my math class, that would mean they were 29 years old back then, and now are 15 years older and still in place.

As for Laurence Tribe, this guy is certifiably a leftwing loon. He exudes “hate” in nearly everything he writes against conservatives, the 2nd Amendment, and esp. Trump.

Think of how many minds he has poisoned in his career.

You also have other legal geniuses like Lanny Davis, who gives the term “sleazy bastard” a new meaning, along with Mike Avenatti and any New York AG.

IF we did an expose’ of how our law schools turned into leftist anti-American, anti-Constitution shithole, it would have to be printed in 10 volumes, each 1000 pages long.

Just stories about the number of Communists, Marxists, and far-left activists in law schools would take up 7 volumes of the 10. Harvard, Yale, NYU, Georgetown Un (yes, that one fine Jesuit school is now a center of both Marxism and extreme leftist Liberation Theology), Northwestern (remember Bernadine Dohrn worked there), Boston Un., John Jay College, Un. of Chicago (which has many fine professors despite the red ones), UCLA, etc.

Jennifer Rubin is to logical writing and law as Jeffrey Dahmer was to being a Cordon Bleu chef.

A waste of time to even have this discussion unless Barack Hussein Obama is indicted, arrested and sentenced to imprisonment for life. Or executed.

Can't be any series of crimes more deserving of the ultimate penalties than what this impostor perpetrated on the United States of America.

The African impostor set out to fundamentally transform (destroy) our Republic, and he almost succeeded.

I have a better question; If a FISA warrant was issued on fraudulent grounds and it subsequently led to the appointment of a special counsel who then sought prosecutions against people for anything he could find outside of the scope of his appointment, isn’t it all poisonous fruit?
