Lockyer rejects halt to nuptials He dismisses governor's as a political ploy (CA RATS ALERT)

State Attorney General Bill Lockyer on Saturday rebuffed Gov. Arnold Schwarzenegger's demand that he force an end to San Francisco's same-sex marriages, calling the directive political rhetoric.

"The governor can direct the Highway Patrol. He can direct the next 'Terminator 4' movie if he chooses. But he can't direct the attorney general in the way he's attempted to do," Lockyer said, adding that Schwarzenegger's written directive "was a statement designed for consumption at the Republican convention."

That's an idea! Why not get recall petitions going for all the DemocRATS elected statewide. It could be called a Total Recall.

Although those who work with Warren say he's openly gay, it wasn't reported publicly until San Francisco magazine made a passing reference to it in a lengthy article on the case. Warren declined Bay Windows request for an interview. His clerk, Mary Melvin, said that although he gave KRON-TV an interview after the dog-mauling verdict, he decided not to talk to the media again at least until after the case completely leaves his court.

Not so simple. Arnold can't arrest Lockyer, and Lockyer's refusal to enforce Prop 22 is not indictable. Arnold can't even fire Lockyer.

The answer is to recall the AG. It will tie up a lot of Democratic money that could be used elsewhere, like on a Senate or presidential campaign.

CALIFORNIA CONSTITUTION
ARTICLE 5 EXECUTIVE

SEC. 13. Subject to the powers and duties of the Governor, the Attorney General shall be the chief law officer of the State. It shall be the duty of the Attorney General to see that the laws of the State are uniformly and adequately enforced. The Attorney General shall have direct supervision over every district attorney and sheriff and over such other law enforcement officers as may be designated by law, in all matters pertaining to the duties of their respective offices, and may require any of said officers to make reports concerning the investigation, detection, prosecution, and punishment of crime in their respective jurisdictions as to the Attorney General may seem advisable. Whenever in the opinion of the Attorney General any law of the State is not being adequately enforced in any county, it shall be the duty of the Attorney General to prosecute any violations of law of which the superior court shall have jurisdiction, and in such cases the Attorney General shall have all the powers of a district attorney. When required by the public interest or directed by the Governor, the Attorney General shall assist any district attorney in the discharge of the duties of that office.

Also pretty clear, the AG works for the Governor. If the AG doesn't do what he's told move on the the assistant AG, etc. etc.
