Nothing at all in the article about obscenities. It said the cop thought she was 'talking too loud on her cell phone'. Maybe he had a hangover and couldn't bear any noise.

I agree with you. Any man who throws a pregnant woman to the ground because he felt she was "talking too loud" must have been raised in a barn. I feel sorry for his wife if she ever raises her voice to him.

No flaming here. You nailed it. We can armchair quarterback this thing to death too. I can't give to much creedance to the Post when reporting on matters of the police.

On a side note; this was in a mass transit area where certain laws or municipal codes are in effect not applicable elsewhere. Activities like profanity, yelling, public disturbance or even spitting can arise to unlawful conduct. In my town we have a specific criminal ordinance for these matters in transit environments.

You nailed it. If a man threw his pregnant wife to the ground and she called 9-1-1, this same cop would arrive at the house and arrest him, no matter what the wife had just done. It really amazes me how many folks in here back the police even when they behave like criminals.

The lady shouting on the cellular telephone and DUI/DWI checkpoint are two completely different things. In the cellular phone incident, a specific person was identified as causing a disturbance and she was "called" on it by the police. She was not questioned on her intended travels or to whom she was speaking. No comparison between the two.

At least you seem willing to go along whatever the enforcers personally decide for you, which at least is consistent with your weak views on freedom.

Your unnecessary rudeness in this thread is ironic and maybe hypocritical given the stand you have take on this woman's case; and it speaks for itself, and is unbecoming to someone who has in the past has at times posted sensible thoughts (I looked).

That was the point of my original post. She wasn't violating the rights of others, per the USSC rulings that I found. Persons have the right to be obnoxious, loud, buffoons. She was rude, to be sure, but it certainly wasn't a crime. Most people would have said.."sorry, I'll keep it down." The fact that she didn't is telling of her character, but it is not a crime either.

No, it's not. Not any more than blasting your stereo is an extension of your mouth. A voice can get only so loud.

And even if you did honk your horn and wake me up at midnight I wouldn't want to see you (or your pregnant wife), get thrown to the ground for it. It's just not all that important. Enough is enough with this 'tough cop' mentality that runs through this country. Get tough with the low-life criminals out there, not with pregnant women talking on cell phones.

Disturbing the peace is a crime. Resisting arrest is a crime.

She was not disturbing the peace. On top of that, you cannot be convicted of resisting an illegal arrest.,P> the city is going to pay for this one; and they should.

Lord love a duck, don't the police officers in NYC have anything else to do except throw pregnant women to the ground for cursing at them? They must have manpower to spare for this kind of patrol. I guess they also do the same to a smoker who lights up in a restricted zone, too.

Sure thing, then how do all these kids with boom boxes manage to not get arrested? And the ten zillion megawat stereos with all base all the time in the cars, pull them over and arrest them too? As for the 'resisting arrest' charge, that's the most common 'tack-on' charge the police use to protect themselves when they know they've over-reacted. He could have ticketed her, that was the best way to go. The 'offense' was utterly petty.

So if I'm "done speeding" when a cop pulls me over for speeding, then you're saying the cop can't write me a speeding ticket because I'm no longer speeding?

Orders? wtf, is this a military State now? You get arrested for talking too loud on your cell phone? Sometimes I call my elderly, infirm mother on my cell phone to check her and I have to practically shout because she's nearly deaf. This thing smells.

I think the people who back the cop on this one would take the complete opposite side if it happened to them. She could have been ticketed and fined perhaps, that would have been more than enough for the "crime".

Hey, I'm just pointing out the obvious weaknesses in your arguments.

I am using facts to form my opinion and adding my own William F. Buckley-esque sardonic wit.

This woman had several ways to possibly avoid arrest, but she made the bad decision to get on the wrong side of the cop.

If you have ever read any Wambaugh novels you will know that being a cop doesn't mean just running around enforcing laws. They also maintain order, and this is done by being the alpha dog on the block.

Any challenge to your authority cannot be overlooked, as it would instantly lead to every other scumbag and his brother trying to get up on you.

These are the cold hard facts of policing. And I bet this beat has a surprisingly crime free streak for the next month or so as this story gains circulation.

Lance's little comments have nothing to do with being a realist or a straight-shooter.

They are rude and they speak for themselves; and again I want to point out how ironic it is that he (or she) is continuing to create a rude atmosphere with personal attacks that are against the rules of this forum at the very same time that he is claiming a woman deserved to be arrested for criminal rudeness.
