Attorneys for a teenage girl who was sexually assaulted at a Culver's restaurant in Chaska have sued the chain, claiming the assailant who also worked at the eatery was a sexual predator about whom other employees had complained.
The suit, filed in Carver County District Court on Friday, alleges that Culver's failed to take action against the man, Luis Garcia-Jimenez, 20, following previous complaints. He wound up sexually assaulting three women who were his co-workers, the suit claims.
Garcia-Jimenez, a citizen of Mexico, was convicted in August in state court in Carver County of three counts of fourth-degree criminal sexual conduct. U.S. immigration authorities have deported him to Mexico.
The suit was filed on behalf of one of the women Garcia-Jimenez assaulted, a minor 16 or 17 years old, said her Minneapolis attorney, Marshall Tanick. The defendants are the Culver's in Chaska, the restaurant's franchisor and Garcia-Jimenez.

Apparently he was convicted and deported, so the ACLU won't have anything to do. The current case is a lawsuit against the restaurant chain for keeping this guy employed, even though they had sexual abuse complaints. I doubt the ACLU will be interested.
The fundamental premise of government is protection of lives and property. When the leadership fails to perform that basic task it is time for the citizens to intervene; even forcefully when traditional means fail.
He's probably already back in the USA.

Wouldn't it be nice if our government were punishing Culver's for hiring illegals? Guess its up to the nasty trial lawyers to get it done.
I hate it when people sue over the least little thing, but in this case, based on what's in the article, I think the girl is well justified in suing the restaurant, for failing to take reasonable steps to protect its workers, and for negligent hiring...and quite possibly for hiring an illegal immigrant. Not too many restaurants do background checks.

That is information we don't have. I don't know if he's back or not. I do know that he was convicted in a court of law.

And there's the crux of this situation. What have you done to insist that employers of illegals are prosecuted? That's the key issue here.

Seriously, I'm disappointed in Culver's - whom I've taken as a wholesome alternative to McDonald's.
I'm all for that. Remove the demand and the supply will stop flowing. It applies to all things illegal.
IANAL What is fourth-degree criminal sexual conduct? Copping a feel?
When I was a kid the first step would have been to break the offending limb (truth be told it came up twice, once we stoned the car as the fool sped off, the second time we beat a perv bloody before the cops showed up, got the facts (whipped it out on a 14 year old girl) and took over the beating). If this step has been omitted the miscreant is getting off easy.
I'm not registering to read the rest of the article.........but what is excerpted here says nothing about him being an illegal.
If something in the rest of the article states he was here illegally, I would agree with you, however there is nothing wrong with hiring citizens of other countries that are in the US legally.
As to the case at hand - as much as I hate our sue-happy culture, I hope these women get a judge that teaches this employer a major lesson, financially.
Was the perp here legally? If not - Culver's is liable for that...and, for having a hostile work environment as well. I would hope they would be smarter than that...
