Was the perp here legally? If not - Culver's is liable for that...and, for having a hostile work environment as well. I would hope they would be smarter than that...
I don't think illegal aliens should be employed in the United States. There are laws against employing them that are not enforced. However, the restaurant chain is responsible for the actions of its employees, so they should pay.
I'm sure a business that figures it can get around labor laws, tax laws, social security, workman's comp, EOE and other laws by bringing in illegals, would figure it can break sexual harassment laws and whatever other laws it doesn't chose to follow. And the government just looks the other way --- preferring to prosecute honest businesses that overlooked one little OSHA requirement.
