Teen sues Culver's over assault-Assailant was former co-worker

Attorneys for a teenage girl who was sexually assaulted at a Culver's restaurant in Chaska have sued the chain, claiming the assailant — who also worked at the eatery — was a sexual predator about whom other employees had complained.

The suit, filed in Carver County District Court on Friday, alleges that Culver's failed to take action against the man, Luis Garcia-Jimenez, 20, following previous complaints. He wound up sexually assaulting three women who were his co-workers, the suit claims.

Garcia-Jimenez, a citizen of Mexico, was convicted in August in state court in Carver County of three counts of fourth-degree criminal sexual conduct. U.S. immigration authorities have deported him to Mexico.

The suit was filed on behalf of one of the women Garcia-Jimenez assaulted, a minor 16 or 17 years old, said her Minneapolis attorney, Marshall Tanick. The defendants are the Culver's in Chaska, the restaurant's franchisor and Garcia-Jimenez.

I don't think illegal aliens should be employed in the United States. There are laws against employing them that are not enforced. However, the restaurant chain is responsible for the actions of its employees, so they should pay.

Yes --- for a minute one could have thought you had become part of the open-borders crowd. Well --- they're not really a crowd --- I think you can count them on one hand.

the responsibility of the restaurant chain for keeping this man employed, even after complaints of sexual abuse.

I'm sure a business that figures it can get around labor laws, tax laws, social security, workman's comp, EOE and other laws by bringing in illegals, would figure it can break sexual harassment laws and whatever other laws it doesn't chose to follow. And the government just looks the other way --- preferring to prosecute honest businesses that overlooked one little OSHA requirement.
