No Reason for Giddiness over These Judges (Rush is Right!)

Rush 24/7 is a helluva good site. I don't want to deprive Rush of income, so I am going to redact (edit) some of his commentary and still get the idea across. For those of you wondering if you should do it, spend $6.95 for one month and see if you agree.

I think this is worth hearing, because it fits my opinion pretty accurately.

Rush says:

"All right, folks, I want to start off here with the judge deal. I'm starting to see some giddiness out there from people on our side that these judges are being confirmed this week...You know why you're giddy? You're giddy because expectations have been lowered. The liberals have successfully lowered expectations, and people on our side are buying it. These judges, under traditional and normal circumstances, should have been confirmed years ago...

"This is really nothing to celebrate in terms of a big victory because this is the normal way that judicial nominees who come out of the judiciary committee get confirmed. You know, this is what's always happened in the past after you win elections. This really is nothing to go gaga over."

"...You know, if you're all excited, say, "Wow, man this is cool! All right, we are kicking butt!" Folks, this is what should have been happening all along. This is what always used to happen. It has taken years to get to what always used to happen. We were always supposed to get judges. That's why you win elections."

"...This is about We the People -- and, you know, we worked hard, a lot of you did, to get certain people elected, and there are reasons that people get elected, and this is one of them. You get to shape the judiciary after you win elections. We are the ones who are driving this agenda, as we should be, and I think it's a little defensive and almost a little bit like minority thinking that, "Wow, man, okay, we got our judges in there."

This is just a small sample. I don't work for Rush, but reading the whole thing is worth it.

This is akin to me being proud that my ten year old kid remembers to flush--it should've been happening for years anyway; he gets no special prize for that.

Rush is absolutely correct about this. Getting this small amount of judges confirmed after all this time is nothing. BTW, Rush is taking too much time off IMHO. Please don't get married again Rush.

I don't know who's "giddy" about a few judges (finally) being confirmed. I think most people are waiting for the other shoe to drop. I want to see the 'pubs show some guts when the RATS renege on their deal.

I subscribe to Rush on computer, and it's some of the best money I spend. At night, instead of watching TV, I turn Rush on through the computer and listen to as I go to sleep. The show takes less than the 3 hours on the radio because all the commercials are taken out.

Rush is always so upbeat, he's better than TV.

I reserve the right to enjoy every little success we have in reversing 60 years of stupid Republican appointments as well as evil Democrat appointments to the courts. Yes we should be kicking butt with every one of the nominees, but when you've got idiots like Lincoln Chafee "on your side" not to mention the the Twimbos From Maine and Captain Ego from Arizona, every conservative judge that makes it is a victory.

Justice Brown is a Huge Victory. The real test is yet to come, when Frist is forced to use the Nuclear option.

I agree. The easy part is done. Now come the other judges, Bolton and eventual SCOTUS nominees. Then we'll see what the leadership is made of, and who the genuine RINOs are.

All it cost the Republicans was thair soul, presuming they had one to begin with.

In return they got three Judges that the Democrats did not care if they were confirmed anyhow. The two Judges that the Democrats really wanted to block , were blocked, probably for good.

Oh, the Democrats moaned, groaned, and caterwalled before allowing them to be confirmed, but it was a "do anything to me you want but please don't throw me into the briarpatch" thing.

God bless Rush for doing his part; it's his job to keep the base perpetually edgy. Without that fire from people like Rush, the establishment R's in Washington would happily go back to the good ol' days of collegiality and submissiveness.

However...I think in all honesty we're entitled to a little giddiness. We're getting our judges through. And in so doing, we are tilting the balance of power in the federal judiciary in our favor for the first time in decades.

The facts on the ground are what they are.

We can cry and wail and gnash our teeth or we can take stock of the situation, be happy that these fine and qualified people have finally been confirmed and continue to fight the good fight despite the setback.

I prefer to go from here rather than wallow in what might have been.

PS..Graham, McCain, et al should be held accountable for their betrayal.

Ditto that!!

BTW the $2.70 per month I pay for 24/7 is well worth it.

Rush has remained consistent.

Some of the rest of us have remained consistent from before to now.

Anything less than an up and down vote on the floor of the Senate for these nominees is unacceptable. This is what we stated before, and this is what we state now.

I am not going to be giddy that three receive votes. Had the dwarfs not signed this Judas Pact these THREE would have all been confirmed! Good grief. Some are celebrating what we would have received if that damned pact never existed and these Senators had done their job and ended the unconstitutional filibuster.

We are NOT the minority. For a Minority this would have been a good deal. We are the Majority. Anything short of all Justices given a vote is not a victory.

Page me for celebration when that filibuster is NEVER again used to stop the appointment of qualified Justices. THEN I will celebrate. But I doubt that is the case. It is far more likely we're going to have to spend months building again to momentum to take down this filibuster that could have been ended a month ago. wasted time, wasted opportunity, and I am furious that extra effort must be expended to win a battle we already had won.

Because Frist and our guys credibly threatened the nuke option, the McCain gang was forced to work out the compromise. The compromise is not as good as the nuke option, but it is better than nothing. The glass is at least half full...

Well, Rush is right 97+% of the time, but this time he's not.

If the Dem's had gone through with their stated intentions if the nuke had been done a couple weeks ago, there would have had to be a "cloture" vote on everything from nominations for dog catcher to the most "important" legislative action - and every single "amendment" to every single action - followed by a nominal I believe 30 hours of "debate" as well as whatever "debate" preceded the cloture vote. Typically, these things get done by "unanimous consent" in the Senate and many things are simple voice vote, often on a whole group of issues or nominations at once.

I disagree that time has been lost by trying things this way. For certain, there would be two less conservative judges on the bench by now, and we'd be in the middle of the 30hrs on the other if all went well. If the Nuke had been done, that would have laid to rest for all time the question of whether a President would get an upordown on his nominees, but for this session of Congress, at least, the Dems could very well have ground business to a painful crawl, as they threatened.

Who would win the PR battle then? - I dunno...

This is worth trying.

I'm not celebrating these three judges as he's right they ought to have been on the bench long ago, but I am celebrating that the Demodogs have agreed not to filibuster judges for the next 1.5yrs --- We'll see.

I don't think the 'deal' will last forever, but at least three of the most constructionist judges in the nation are now on the Federal Bench.

They agreed not to filibuster unless in undefined extrodinary circumstance. The Democrats consider 51% of the American public extrodinary for electing G.W. President. This turn of phrase does not engender trust.

This is not the same as agreeing not to filibuster throughout the rest of this session of Congress.

I would counter your contention that cloture would be called slowing activity on every item, with the reality that filibusters have been extended to cabinet positions. A direct consequence of having been emboldened by the use of the filibuster in Judicial nominations. If not defeated, it'll spread into other areas like a virus. Since in either instance they will find a way to slow and delay even in legislative matters (where is S.S. right now?) it is better to uphold the Constitution than to leave it in question.
