I doubt the town will condemn Souter's land but they probably won't have a problem condemning John Doe's land down the road and offering it to the developer instead.

So tell me, if the local government rejects it, can the developer take them to court? And if he continues to lose, couldn't this theoretically wind up in the U.S. Supreme Court??

Yes. The SC ruling didn't say that only private property beloning to working stiff's is subject to seisure. Where does Ruth Bader Ginsberg live????

The lower court's ruling is upheld. My understanding is that SCOTUS doesn't hear cases of original jurisdiction any more. (But if they did, what would happen if there were no lower court ruling?)

If a majority of the CURRENT board doesn't approve of the plan, there are likely other residents who could run for the board and this could come to pass eventually.

The name of the hotel reminds me of the Simpson's episode where Homer built the koi pond, but a screamapillar took up residency there and he couldn't kill it. The EPA official who told Homer he couldn't kill the bug cited the law, "The Reversal of Freedom Act of 1994".

Might as well call the laws by true descriptive names.
