This is not a news story, because you will probably never see it printed in the news. I am somewhat late in posting this because I thought for sure someone else would have.

To spare you reading the government gobbledy-gook, I'll summarize. Under the auspices of our "pro-second amendment" president, and with the urging of AG Gonzales, the BATF, by fiat, has reinterrpreted the Gun Control Act of 1968 to make importation of gun barrels illegal as of September 10, 2005. This primarily affects military type weapons deemed "not having a sporting purpose."

Who cares? We should all care. This is a perfect illustration of the insidious errosion of our Constitutional rights. Without justification, previously legal gun parts will be illegal overnight, futher restricting supplies of firearms to law-abiding citizens. A stealth ban is a ban, nonetheless.

What is the effect if someone wants to import a MAK-90 barrel to replace a worn-out barrel on a pre-1990 semi-auto AK?

AG Gonzales

Guns for the peons are banned in Mexico. Only the government has them legally, and of course the narcotrafficantes have entire arsenals illegally. In other words, only the Patrons, the Caudillos, have armed power.

Sr. Gonzales aspires to be one of the Patrons, and do it here in the United States, once the land of the free and equal.

The idea being to make this country just like the country where his roots and his loyalties lie.

Is it lawful for the BATF to issue an edict like this without new Congressional action? Sounds highly suspect to me.

I don't know what we'd do without the republican majority and 'you know who' to protect us from stuff like this.

Some of those folks in Washington who claim to support the Second Amendment need to take AG Gonzales aside and let him know that he and his boys at the BATFE stepped in it.

President Bush, it's time go go attorney general shopping!

I was shocked that this did not get posted earlier, to the point I decided it must have been pulled as being too critical of AG Gonzales!

Bubba Klinton at least pressed his anti-gun rights agenda out in the open, this attack, and the recent ITAR Fee increase, were both done without any consent of, or even fair notice to, our reps in congress.

This "reinterpretation" has NOT gone into effect yet, (60 days after the notice) there is still time to demand that congress BLOCK it's implementation, and demand that the AG return to the traditional interpretation of the past several years.
I strongly suspect that this change was "coincidentally" timed to take effect while congress is still in recess, or immediately after they return, in order to prevent congress having any chance to prevent this feculent change.

There is another way to stop this, DEMAND that congress pass H.R. 1703, a bill which would delete the entire "Sporting Purposes" charade from federal law. No "S.P." requirement means no distinction can be made.
H.R. 1703 would set the sedition minded gun banners agenda back by decades!

Please ask your reps to become cosponsors of H.R. 1703, it really is THE bill we need to truly cripple the "Gun Control" crowd.

While you are at it, I would ask that you also voice support for H.R. 2088 (VHFA Bill) and H.R. 1603 (Fairness In Firearms Testing).

ALL of these bills attempt to do great things for our RKBA!

They have ALWAYS been illegal unless they were being imported as a replacement barrel only. Far too many people have been ignoring this and building NEW weapons of out so called "parts kits". They were open and obvious about it -- not discrete at all. If people had more discretion the BATFE would have continued to look the other way.

You're not looking at the big picture. We need to increase the senate majority to sixty five members and then with a filibuster proof majority, we can get judges that will give us what we want. If we still can't get what we want we'll work for seventy republicans. (SARCASM)

Why aren't our elected representatives watching these bureaucrats? Why doesn't one of our elected representatives stand up and say "Hold it right there Batfag. You can't do this".

I guess I better not hold my breath.

UPDATE!

New ATFE "Open Letter" extends import deadline.

REVISED OPEN LETTER TO FEDERALLY LICENSED FIREARMS IMPORTERS
AND REGISTERED IMPORTERS OF U.S. MUNITIONS IMPORT LIST ARTICLES
The purpose of this open letter is to provide important updated information to importers
concerning the lawful importation of certain frames, receivers and barrels.
Extension of Time to Effect Importation of Approved Permits for Frames, Receivers or
Barrels of Firearms Under Title 18 U.S.C. § 925(d)(3)
As noted in our prior Open Letter dated July 13, 2005, section 925(d) provides “in any case
where the Attorney General has not authorized the importation of the firearm pursuant to this
paragraph, it shall be unlawful to import any frame, receiver, or barrel of such firearm which
would be prohibited if assembled.” ATF concluded that this language permits no exceptions that
would allow frames, receivers or barrels for otherwise nonimportable firearms to be imported
into the United States. Accordingly, ATF announced that it would no longer approve ATF Form
6 applications for importation of any frames, receivers, or barrels for firearms that would be
prohibited from importation if assembled. No exceptions to the statutory language, for example
for “repair or replacement” of existing firearms, will be allowed.

In the July 13, 2005, Open Letter, ATF recognized that importers relying upon ATF’s prior
policy may suffer economic harm, particularly those who hold approved permits. To mitigate
the impact of the new policy, ATF provided that it would forego enforcement of section
925(d)(3) for 60 calendar days from the date of the Open Letter for those importers who had
obtained import permits for barrels and receivers for nonimportable firearms for "repair or
replacement."

Following consultations with the industry and further examination of the number and types of
barrels and receivers authorized for importation on approved permits, ATF has decided to extend
the period of time for importers to act upon previously approved import permits. ATF believes
this extended period affords ample time for importers who have entered into binding contracts in
reliance upon approved permits to bring their shipments into the United States for entry into
commerce. Importers holding ATF approved permits to import frames, receivers, or
barrels for otherwise nonimportable firearms for repair or replacement may continue to
use such permits through December 31, 2005. Effective January 1, 2006, these permits will
be suspended.

Importers holding unexpired approved permits will be receiving a letter notifying them that their
permits will be suspended effective January 1, 2006. ATF will advise Customs and Border
Protection that in no event should these permits be accepted to release these items for entry into
the United States on or after January 1, 2006.

Importers are reminded that no new permits for these items will be issued, including the issuance
of permits that would be necessary to remove frames, receivers or barrels that are currently held
or may be placed in a Customs Bonded Warehouse or Foreign Trade Zone. Importers are also
advised that ATF previously approved permits for nonimportable barrels and receivers are for
repair or replacement only, and this restriction was stamped on the face of the permit. Importers
who import such components for any purpose other than repair or replacement of existing
firearms, e.g., for assembly into new firearms, will be exceeding the scope of the import
authorization in violation of law. If ATF determines, through inspection or otherwise, that an
importer willfully violates the import provisions of the GCA, the importer's license is subject to
revocation pursuant to 18 U.S.C. § 923(e).
