Senate Republicans reached agreement last night on a compromise immigration measure that they believe will garner enough bipartisan support to break through a parliamentary impasse that has stymied progress on a high-stakes border security bill for two weeks.
Under the agreement, the Senate would allow undocumented workers a path to lawful employment and citizenship if they could prove -- through work stubs, utility bills or other documents -- that they have been in the country for five years. To attain citizenship, those immigrants would have to pay a $2,000 penalty, back taxes, learn English, undergo a criminal background check and remain working for 11 years.
Those who have been here a shorter time would have to return to one of 16 designated ports of entry, such as El Paso, Tex., and apply for a new form of temporary work visa for low-skilled and unskilled workers.

Employers who go to street corners an pick up cash, day laborers are knowingly breaking the law!
But since they're not Mexicans, you want to give them a pass.

They should go to jail.

"Any person who . . . encourages or induces an alien to . . . reside . . . knowing or in reckless disregard of the fact that such . . . residence is . . . in violation of law, shall be punished as provided . . . for each alien in respect to whom such a violation occurs . . . fined under title 18 . . . imprisoned not more than 5 years, or both."
Throw some Tyson execs, or the soccer mom who drives to the local illegal laborer pick up spot to hire a maid and a gardener in jail andsee how fast the rest stop hiring illegal aliens.

That's not PART of the problem, that IS the problem. Everything else is a symptom of that problem, and a direct result of the fact that there are jobs being given to illegal aliens.
They come because they know they can get jobs, if you eliminate the jobs by sending people who hire them to jail, as prescribed by the law, they will stop coming because the jobs will dry up.

If the government was doing ITS job.....(obeying/enforcing the law)
If the employers were doing THEIR job....(obeying the law)
and the border was sealed......we wouldn't be having this problem. You are placing ALL the blame on employers, whose job is not to act as Border Patrol, Customs Officials, or Law Enforcement. They are a piece of the problem, and are breaking laws with impunity. (Impunity from the government, I might add.) You are asking employers to become unauthorized, unequipped law enforcement officials....who are not being prosecuted by the very government which refuses to arrest/deport illegals. Which comes right back to the government doing nothing to stop illegals.
So, again, what is your point?
There is zero enforcement in the bill now under consideration. This is the usual unfunded mandate that local communities like to indulge in and even Congress gets so distracted by late night conferences and floor debate that they lose sight of implementation of their wonderfully compassionate product.
Every problem has both a cause and an effect. In this case the cause is the employers who give illegal aliens jobs, the effect of course being the growing numbers of illegal aliens coming to get those jobs.
So then, what's the shortest route to solve the problem?
Address the cause, not the effect.

If I go to the corner where all the illegals congregate to get work, and hire people on a cash basis for the day, I know EXACTLY what I am doing.
I am committing a Federal crime...a felony to be be exact.
People do that all the time, otherwise the illegal would not congregate there every day.
The illegal is guilty of a misdemeanor, the person who hires the illegal is guilty of a felony.
And when I hear from the mouth of an illegal, on national t.v., a REASON for his coming to the U.S., just this past week, was due to the imminent AMNESTY being passed...I would say that is a CAUSE for illegals coming to the U.S.
Along with jobs they are illegally acquiring, they get medical care, education, disability benefits, paid for by the taxation of American citizens and those legally here.

In America, employers have a duty to obey the laws required of them. What are those laws?
1) Employer Responsibilities/Time Frames
The Personal Responsibility and Work Opportunity Reconciliation Act of 1996 requires employers to report new hires within 20 calendar days of their being hired. If reporting electronically, new hires must be reported at least twice a month, 12 to 16 days apart.2) All U.S. employers are responsible for completion and retention of Form I-9 for each individual they hire for employment in the United States. This includes citizens and noncitizens. On the form, the employer must verify the employment eligibility and identity documents presented by the employee and record the document information on the Form I-9. Acceptable documents are listed on the back of the form, and detailed below under "Special Instructions."
Do not file Form I-9 with U.S. Immigrations and Customs Enforcement (ICE) or USCIS. Form I-9 must be kept by the employer either for three years after the date of hire or for one year after employment is terminated, whichever is later. The form must be available for inspection by the authorized U.S. Government officials (e.g., ICE, Department of Labor).
Where is the provision that allows employers to do law enforcement work? They are only supposed to comply with the law by provide information to the Federal government about their new hire, after being provided verification information and retaining forms to prove that they verified employment eligibility.
So....what part is it that don't you understand about employers not having the same duties, or abilities, as law enforcement (whether that be local, state, or federal law enforcement officials)?

Current 2005 illegal estimates vary between 14,000,000-22,000,000 nationwide.A study by The Federation for American Immigration Reform estimated that in 2004 the annual uncompensated cost of medical care for illegal immigrants in California was $1,400,000,000. Total uncompensated educational, health care and incarceration costs were estimated to be 10,500,000,000.
Care is frequently provided to illegal immigrants by emergency rooms and is provided when a crisis exists rather than as preventative practice. Both phenomenon add to the high cost of health care. For 12 states, the government pays hospitals for providing emergency services to Illegal Aliens. In 2005, the state of California got $70,000,000 to help with dismal shortfalls. California's San Diego County was about $100,000,000 in the red and Los Angeles County about $140,000,000.
