[Oregon Supreme] Court Rejects Medical Marijuana Defense

Salem -- The Oregon Supreme Court ruled Thursday that an employer didn't have to make an allowance under state disability laws for a worker who used medical marijuana.

The worker, Robert Washburn, was fired from his job as a millwright at a Columbia Forest products plant in Klamath Falls after failing drug tests.

Washburn had a state-issued card allowing him to use marijuana to ease leg spasms that disrupted his sleep. He used the drug at home, but the company, which has a policy prohibiting workers from coming to the plant with controlled substances in their systems, fired him in 2001 after he failed several urine tests.

Washburn sued, saying his condition left him legally disabled and that required the employer to make reasonable accommodations.

In its ruling, the Supreme Court determined Washburn's impairment did not rise to the level of a disability . . .

Folk remedy for leg spasms while sleeping:

Put a bar of soap under the sheets at about knee level. Seems to work for Mrs. Bruck, although I can't imagine why. Good thing too, as we're not allowed to use medical marijuana! :)

He should have used Vioxx, it's much less dangerous than marijuana. Look at all the people who are dying daily, having heart attacks and such from using marijuana.

Why not prescribe Methodone or Oxycontin? I'm sure Morphine would do the trick. Anything but the dangerous marijuana plant.

Listen to the side effects warning every time you hear an advertisement for some prescription drug. It usually goes something like, "people should not use ____ who are allergic to anything. Don't use ____ if you have a history of heart disease in your family. Side effects may include shortness of breath, stomach cramps, internal bleeding, and explosive diarrhea. Call your doctor immediately if you have an erection lasting longer than four hours."

If you they sold marijuana cigarrettes, the warning on the box would read:

May cause fits of laughter and intense munchies.

An employer is not obligated to employ someone. Companies have changed their work rules, then fired people for coming in smelling like smoke. (Happened just the other day at a local hospital). This guy should just go find an employer who wants to hire him.

Yeah, I did that. Wound up in the emergency room. My ears have had a permanent ring for three years.

I would imagine his employer offers health insurance. No other drug works for this guy's "leg spasms"?
