Raleigh The North Carolina State Bar has filed an ethics complaint against Duke lacrosse prosecutor Mike Nifong.

The lawyer who is the subject of the complaint gets notified within 15 days, I believe.

"I think it will go like this:
1. Nifong sworn in.
2. Case dropped.
3. Nifong retired as his cancer comes back or some other medical issue arises.
4. Case dropped."
What about all of us, and the aggrieved parties? Methinks there are plenty of good people that will follow this POS to the ends of the earth in order to ensure that he suffers for what he has done.
No, not really, although it seems like it. Many are self-regulated incorporations with a private charter (ostensibly) for public benefit. It has to do with whether or not the state bar is a unified bar or not. If not, the state bar is usually attached to either the state supreme or appellate court.
I don't know the rules for Grand Juries here in NC, but my term was in California before the law changed to require records be kept. I hope some Grand Juror comes forward and says that Nifong misrepresented the evidence, like he did to the judge.
That's true of all grand juries. Being called to testify is another question altogether.
So they're all in it.

Earlier, I wrote to the author, Erin Coleman, urging her to publish an IMMEDIATE correction, lest she further contribute to the tarnishment of her publication, which has otherwise botched coverage of this story.
I'm hoping the case will dropped. The charges rely completely on the credibility of the victim and the victim has no credibility.
The pratical solution is for another prosecuter to take the case and review the merits, but I just can't see how any prosecuter would want this debacle. Fortunately or unfortunately North Carolina will more likely let Nifong "hang himself".

just hope those 3 guys sue him for everything he had. Maybe their attorneys can even find some way to sue Sharpton and JJackson and 'attach' the scholarship moneys Jackson supposedly provided for the accuser

As I said earlier, Nifong may well not have even appeared before the grand jury. Probably Gottlieb did.
The evidence they were indicted on was probably something like this:
1. Mangum says she was raped. [This is true.]
2. She picked out Finnerty and Seligmann. [Evans for a later grand jury.] [This is true although the lineup was rigged.]
That is a prima facie case. I doubt anything more than that was said.
Nifong is required to present exculpatory evidence to the grand jury. But he refused to meet with the defense attorneys so that he would not know of any such evidence.
Unless they were stupid enough to lie about the SANE report or to lie about the DNA, Nifong is probably ok with the grand jury. His refusal to listen to exculpatory evidence might be a further charge. Certainly hiding the DNA evidence is a future problem.
And I am still waiting to see if DA Johnson will just ignor a crime in Alamance Co.
The next move by the defense will be a motion to have Nifong (spit) pulled from the case based on the ethics complaint.
This may be the plan all along, providing cover for Nifong with his black racist buddies and making an ADA take the fall for dropping the case.
Of course by definnition if one is in violation of your ethical requirements, one is not acting in ones official capacity. I believe the courts have held under such circumstances Nifong may be sued.

Note on NC Grand Juries- the recent swat team killing of the 18-yr old
Durham boy in Wilmington, NC produced a quick Grand Jury indictment
of the sheriff's deputy involved.
The next day the Grand Jury foreman said he made a mistake and checked
the wrong box on the paperwork- it was not a True Bill-- uproar and questions-
a member of the grand jury was then quoted by name in the papers detailing
the proceeding---- seems the secrecy thing was not too secret down east.
But Nifong stated publicly that DNA evidence would show that the Duke students committed the crimes. Lies, lies, lies. Don't you think he probably stated that through either a document or through Himan's or Gottlieb's testimony to the Grand Jury?
Not that they need any help with that.
