Interviews Underway for District Judgeship
Those known to have interviewed for the judgeship this week are lawyers Kerry Sutton and Brian Wilkes, along with Assistant Public Defender Shannon Tucker.

I agree. They're throwing him under the bus to save face and to give the appearance of being pro-active so that they can avoid any legislation that undermines their authority by transferring to or adding the AG as an oversight entity.
I agree. The DA had an initial obligation to look into the rape charges. It is pretty clear now that the DA shouldn't have filed charges or at worst dropped them when the DNA came back negative. Regardless of the outcome of this, this will be a topic of discussion in Trouble Avoidance 101 for jocks and rich kids..

Your position that this is somehow their fault is absurd. I don't approve of their behavior, but it's pretty mild by comparison to a lot of what goes on during spring break.

Showing that case to another DA would be tantamount to a confession, complete with evidence.
I'll try and weasel out of this again. I never said it was their fault. I said poor judgment contributed to the mess.
Spring break behavior isn't legal in all jurisdictions.

Nifong's behavior has been so outrageous that to find fault with anything some young men apparently did is simply muddying the water.
I agree. And as in Black Birch's case, they should quit digging also: The inexcusable cannot be excused.
DAs Call for Prosecutor in Duke Lacrosse Case to Step Down

Dec. 29, 2006 In yet another moral blow to Durham County District Attorney Mike Nifong, the North Carolina Conference of District Attorneys called for the prosecutor to step down from the Duke lacrosse case.

"It's extraordinarily unusual and it means a great deal," said Joshua Marquis, a district attorney in Clatsop County, Ore.
"As prosecutors, we do not try our cases in the media. We do not file charges frivolously," Marquis, who is active in the National District Attorneys Association, told ABC News.
"I do not know what the merit of the charges are, but Mr. Nifong has not brought respect to our profession," Marquis said. "Some of his actions have brought great disrepute on the profession of prosecution."

"My opinion is that this crystallizes the conflict of interest," Thomas Metzloff, a member of the North Carolina bar and professor at Duke Law School, told ABC News.
Right, and it will keep happening unless the prosecutors who are caught engaging in such shenanigans are brought to justice.
I do find it interesting, though, how many liberals are more interested in protecting the guilty than the innocent. Compare the attention Stanley ("Tookie") Williams has received to that of Cory Maye.

The other issue here is Nifong framing innocent persons for rape when all they are guilty of is being sleazy and stupid. The very idea of facing a trial that can send you away for a very long time (even though you are innocent) is a horrible torture.
