Federal lawsuit against Georgia gun dealers clears hurdle (NYC)

A federal judge on Wednesday kept alive a lawsuit accusing Georgia gun dealers of illegally selling firearms that end up being used in crimes in New York City.
In a 99-page ruling, U.S. District Judge Jack Weinstein in Brooklyn said he found ample evidence the gun dealers "have been responsible for the funneling into New York of large quantities of handguns used by local criminals to terrorize significant portions of the city's population."
The judge rejected motions filed by a number of gun shops, including Adventure Outdoors in Smyrna, that sought to dismiss the lawsuit filed by the city of New York. Adventure Outdoors and other gun stores in Ohio, Virginia and South Carolina argued they couldn't be sued in federal court in New York.

U.S. District Judge Jack Weinstein in Brooklyn said he found ample evidence... Not surprising. This will probably be appealed up to Court of Appeals. Pinging NRA....

Jack B. Weinstein (born 1921, Kansas) is a United States federal judge in the Eastern District of New York. Judge Weinstein was appointed in 1967 by President Lyndon Johnson. From 1980 to 1988, he served as chief judge of the district. In 1993, he took senior status; however, unlike some senior judges, he has maintained a full docket (and more) as a senior judge. Because of his longevity, heavy workload, and substantial scholarship he is one of the most famous federal judges to serve his entire career at the district court level.

What crime did these gun dealers commit? Are they being sued because firearms were purchased legally from them & then used in a crime in another state?
Please tell me that is not the case.
If so, my inherent distrust & lack of faith in the government has grown some more.

"Please tell me that is not the case." I think it is the case. But why didn't they charge him as an accessory if he knew why they wanted the guns when he sold them. Otherwise, makes no sense.

His record is anti-gun and anti-2nd Amendment types always seek to have their cases heard in his court. I don’t know how cases are assigned but I’m under the impression that Weinstein can choose his cases regardless of the normal rotation.

Seems to me if there was any such evidence, the proper thing to do would be provide the info to BATF and they would be more than happy to go shut down some dealers and have them prosecuted. Don't see where a lawsuit should come into play if there is evidence of criminal activity.
Of course, they likely have no or little evidence of such activity, only that some guns used in crimes were at one time purchased in Georgia.
Interestingly enough, this was a theme in a movie made in the early 90's called "Strapped". A criminal in NY had a cousin who lived in Georgia so he and a buddy would drive down, have him buy several Glocks, and then they'd take them back to NY and sell them on the street for a grand each.
