A recall effort against U.S. Rep. Tim Walberg is effectively over.
Lenawee County Circuit Court Judge Harvey Koselka ruled today in favor of Walberg's lawsuit challenging the constitutional validity of the recall against him.
"I don't think he won so much as the people lost, really," said James Carr of Jackson, a retired teacher who has led the recall campaign.
Walberg's attorney sees victory differently.
"This is a victory for the taxpayers of the 7th District," said Eric E. Doster, attorney for the Lansing firm Foster, Swift, Collins and Smith.
The U.S. Constitution contains no provision for recalling a sitting member of Congress, even though the Michigan constitution says recalls are permissible.
Carr said he is not going to hire a lawyer to appeal the judge's preliminary ruling, nor is he going to continue collecting recall signatures.
The Dems are lining up to run against Walberg, as is the RINO Joe "I should be a Congressman, Dammit" Schwarz.
What alleged perfidious action did Congressman commit that brought all this on. Or is it BDS, local variant?
Schwarz is a disgusting puddle of runny excrement. The piece of crap decided to run a write in campaign the day before the election in a bid to pull votes from Walberg.
Walberg was the only vote I didn’t have to hold my nose for in the last election and Schwarz is a lesson about voting for RINOs.
Local variant but lets not forget that Schwarz was a Soros puppet (Main street republican) so the roots were national or even international.
And good riddance to pro-illegal loser Joe Schwarz.

The 10th amendment gives all powers not enumerated in the Constitution to the states and the people. Clearly, however, the constitution itself establishes the conditions for serving in the House. It would be unconstitutional for a state to have other conditions, and recall is a condition of serving (ie. not having been recalled). The judge was correct.
