President Obama probably never thought he'd be in Massachusetts on Sunday night. But with Republican Scott Brown surging in the polls two days before the special election for Ted Kennedy's senate seat, Obama has scheduled a last-minute trip to Boston to headline a rally for Democrat Martha Coakley.
Even before Obama scheduled his trip, however, campaign lawyers in both political parties had begun quietly cramming for the colossal legal battle that could ensue should Brown pull off a stunning upset in one of the nation's bluest states.
Republican lawyers fear that if Brown wins, Democrats will use stall tactics to delay certification of his victory till after the U.S. Senate casts its final vote on President Obama's healthcare bill.
That's because right now the interim senator appointed after Kennedy's death, Paul Kirk, could deliver President Obama the key 60th vote on the hotly contested health insurance reform plan.
"Both sides are going to be ready for a fight," said one election lawyer involved in the preparations, who discussed the effort on the condition he not be named.
Brian McNiff, a spokesman for Secretary of the Commonwealth William Francis Galvin, who is in charge of elections in Massachusetts, said attorneys in his office have been fielding a lot of calls from the two sides in recent days.
With so much riding on this vote, the White House and its GOP opponents have propelled the special election onto center stage. Both Republicans and Democrats have poured money into a race that Coakley once led in polls by as many as 30 points. Yep. I’ll tell you, if Scott wins and they deny him his seat while rushing through a vote on Obamacare, I’ll join a march on Boston. I’m only about 40 min outside the city.

Of course the dems will delay seating Brown.
And the Republicans will have to delay the health care bill.
The thing about delaying is that both sides can play that game, and both have the procedures to do so.
The dems want the public to think they are in control, when in fact, the people are in control, and they had better start listening to them.
Put them away. ACORN, MoveOn, SEIU, and the Kennedys themselves will never allow Brown to win this thing. Get ready for Minnesota all over again. Weeks and months of recounts, with nothing but liberals doing the counting, until Coakley is pronounced Masachusettes Senator.

I asked if that was where they were setting up the Haitian Relief Command Center.

Sorry for my less than appealing post, however I resided in MN November 2008 and know the fraud strength within the liberal machine.
Is there a specific state or Federal law about timely certification of a candidate who has won the seat.

I read on another thread that after the election, Kirk is no longer Senator and no longer able to vote. Is that correct?

Say Coakley wins on Tuesday.
When do you think youll see her *in* Massachusetts, giving a rats ass about the the common mans’ plight in the commonwealth of Massachusetts?
Come to think of it: When do you expect to see her at *all* except on TV from D.C., standing behind Chuckie the Schmuck, at Senatorial Press announcements and attending White House parties?
There are two different issues here.
1) Certification of the election by the Massachusetts SoS. Apparently, there is a legal basis for him doing so under State law
2) Voting by Kirk after 1/19/10. There is some legal background under the U. S. Constitution for denying him a vote after the polls are closed on the 19th
If Reid allows Kirk to vote after the 19th, there will likely by a serious constitutional challenge to any bill that passes as a result.
