SEC. 2704. PROHIBITION OF PREEXISTING CONDITION EXCLUSIONS ...BASED ON HEALTH STATUS.

SEC. 1201. AMENDMENT TO THE PUBLIC HEALTH SERVICE ACT.
Part A of title XXVII of the Public Health Service Act (42
U.S.C. 300gg et seq.), as amended by section 1001, is further
amended—
(1) by striking the heading for subpart 1 and inserting
the following:
‘‘Subpart I—General Reform’’;
(2)(A) in section 2701 (42 U.S.C. 300gg), by striking the
section heading and subsection (a) and inserting the following:
‘‘SEC. 2704. PROHIBITION OF PREEXISTING CONDITION EXCLUSIONS OR OTHER DISCRIMINATION BASED ON HEALTH STATUS.
‘‘(a) IN GENERAL.—A group health plan and a health insurance issuer offering group or individual health insurance coverage may not impose any preexisting condition exclusion with respect to such plan or coverage.
’’; and

(B) by transferring such section (as amended by subparagraph
(A)) so as to appear after the section 2703 added by
paragraph (4);
(3)(A) in section 2702 (42 U.S.C. 300gg–1)—
(i) by striking the section heading and all that follows
through subsection (a);
(ii) in subsection (b)—
(I) by striking ‘‘health insurance issuer offering
health insurance coverage in connection with a group
health plan’’ each place that such appears and inserting
‘‘health insurance issuer offering group or individual
health insurance coverage’’; and
(II) in paragraph (2)(A)—
(aa) by inserting ‘‘or individual’’ after
‘‘employer’’; and
(bb) by inserting ‘‘or individual health coverage,
as the case may be’’ before the semicolon;
and
(iii) in subsection (e)—
H. R. 3590—37
(I) by striking ‘‘(a)(1)(F)’’ and inserting ‘‘(a)(6)’’;
(II) by striking ‘‘2701’’ and inserting ‘‘2704’’; and
(III) by striking ‘‘2721(a)’’ and inserting ‘‘2735(a)’’;
and
(B) by transferring such section (as amended by
subparagraph (A)) to appear after section 2705(a) as added
by paragraph (4); and
(4) by inserting after the subpart heading (as added by
paragraph (1)) the following:

meaning you can just pay the fine until you get sick and they buy a policy since they aren’t allowed to reject you....once again, Sarah Palin and her little Facebook page prove correct.

My house just burned down. (that's a pre-existing condition if ever there was one) I now want an insurance company to cover the house and pay for the rebuilding.

How is that any different from requiring insurance companies to pay for a pre-existing medical condition?

How can any insurance company survive faced with potential cost like this?

this is my interpretation. is this the correct interpretation?

I suggest a mass mailing of inquiries to our Congressional staffs, politely asking for help in the decision to drop coverage, and then file for coverage at the point of need.

You can do better than that. Scan the paper for a recent case of arson, purchase the burnt out shell and then apply for insurance to have it restored. You'll save on loan interest and taxes while waiting for the opportunity.

They can’t deny you coverage, but do they have to charge you the same as a healthy person or will there be special policies for people with pre existing conditions (aka Death Care policies)?

That's the Dem's plan. Bankrupt the insurance companies. They just can't come out and say it as such, but.. THAT'S THE INTENT.

Unless of course they change the coverage applications to be so lengthy and confusing that even a “t” left uncrossed or an “i” un dotted could be grounds for denying coverage due to misinterpretation....???

Just saying, I look for the ins companies to do whatever they can or have to in order to stay in business against the regime.

They can’t. They’re not meant to. Health Inscos will become quasi-governmental agencies.

Folks, I understand the issue here, but believe it or not, there are many people who simply are dropped from coverage, lost their job, or got laid off, lose their insurance, or have a sick child born to their family and can’t add them to their existing policy, in the process of switching insurance policies, they drop you for some “unknown circumstance that you didn’t know you had”, etc. Yes, it is unfair that companies should be made to foot the bill for this, but what other recourses are avaialable for people in this situation?..This is, and I hate myself for saying this, where the government needs to step in.

This would be a breech of contract, if true. Is this widely asserted claim true?

It is like ordering a can of beans, paying for the can of beans, and then being told your bean order has been canceled.
