The Environmental Protection Agency has denied a petition filed by environmental activists seeking to ban lead in ammunition, saying such regulation is beyond the agency's authority.
The agency's decision, announced Friday shortly after FoxNews.com published its report on the issue, sided with hunters and fishermen who had argued that the such regulations weren't allowed under the Toxic Substances Control Act of 1976.

Liberals in action--try to get ammo banned so people's right to guns is curtailed, and try to do it through "environmental" concerns.
Just like how the mosque is a "legal" issue, and gay marriage and illegal immigration are about civil rights.
When libs whine about how people don't trust government, or call liberal bad names, I think of this kind of thing. They don't play openly, and they try to go around the rules they expect everyone else to follow to the letter.

While the Enviro-Nuts and Fascist Leftists in the EPA might be dumb, they are not stooopid and no doubt head Mooncalf, Lisa Jackson, no doubt got a call by Dear Leader's Chicago-Thug adviser, "Rhambo" Emanuel "suggesting" they put this on hold, but like all Demo-Rat proposals/agendas (similar to the Night of the Living Dead) look for this to be implemented later this year or next!
What I'd like to see examined and discussed (as it is an area I'm not that familiar with) is how it came to be that Bureaucracies have been given such power and authority and can issue "Diktats" such as this absent any oversight or even any recourse by Congress to halt or reverse such actions.

That argument might fly on the cocktail circuit in Manhattan, but the “keep and bear arms” phrase includes powder, balls, wadding, caps, rods, power horns, and all manner of accessories needed to be “armed”. Even those new fangled cartridges.
The weenies will engage in all sorts of twisted logic to deny others of their natural rights, even those codified by Constitutional amendment. How black their souls must be.

Btw, the EPA dropped this like a hot potato after getting one phone call. It was from that 'do nothing', 'traitorous', 'compromising', 'Harry Reid backing', NRA. Public comment was *supposed* to go to Oct. The EPA shut it down after one day.
NOTE: That was the NRA. Not GOA, SAF or any other org. It was the NRA who 'made them an offer they couldn't refuse'.
There are many alternatives. Lead-free pewter has a melting point on the order of that of lead. Barnes makes all-copper bullets. Ingenuity will always find solutions.

The law that established their authority, specifically exempted their jurisdiction over hunting and fishing uses for lead. Not that any liberal or socialist would let laws get in their way.
Well, hypothetically if they DID ban it, then you would be able to tell it to da judge AFTER your guns and ammo and fishing tackle had been seized and destroyed.
You think just because something is law, that makes some kind of magical difference?

I love the premise that the EPA gets to decide what authority it has, that it is not clear. Congress delegated it’s constitutional role for passing new laws to the EPA. Ha!
People don’t even question the idea.
So from here on out, here is what will happen:
Environmental groups will sue. A federal judge appointed in part due to his or her sympathy to the idea that we should be ruled by experts will decide against the EPA. The EPA will say that “We were forced to act”. The president is then able to point the finger at the courts and congress gets off scot free for having to take responsibility for the laws it passed. Any changes to the law have to pass the Senate, a veto of the President and a Constitutionality check with the courts.
It’s an illusion of a Republic. The elites get the country they want and we’ve lost ours.

I heard of one brand of cartridge that had a hard lead alloy core that the ATF deemed armor piercing and denied further import.
Yeah, they must fear gun owners backlash enough to back off.
Otherwise there’s no way they’d veiw something as beyond their jurisdiction.
