As a matter of fact, yes. People with abnormal metabolisms(diabetics and pre-diabetics) can already register “drunk” with the current legal limits even if they don’t drink at all.

This ultra low limit is going to bring on even more false positives.

It’s standard procedure to write a ticket to drivers that hit deer and other large wildlife. I would imagine the rock is viewed the same way. If you hit a deer, it’s your fault no matter what and you get a ticket. Technically according to the law, that is. But many cops just ignore it.

My uncle was hit by a drunk driver while he was operating his motorcycle - he lost his right leg from above the knee, and nearly lost his life. The driver, who was cited and released, was illegal, had no insurance, and disappeared never to be found again - returned to Mexico perhaps? My uncle lost his job - he worked at a lumber mill - lost his home because he had no income, and his wife left him. It took years before he recovered financially. He was in pain for the rest of his life. I’m with you on increasing penalties for those who commit DUI, and not releasing them with a citation.

Oh, I forgot to add...

there’s a dollar amount of vehicle damage that determines the ticket. I forget the amount. But it’s something like a thousand dollars or more of damage to your car and you are supposed to automatically get a ticket for hitting the deer.

Driving tired causes more accidents than alcohol.

The problem here is revenue for police. Solution; cut the force by 25%, get rid of the ponzi scheme pension plan. Change it to a pension where you get back what you pay into the system plus 5% a year annualized, as opposed to guys paying in $30,000 and collecting $500,000 over the course of their retirement. We aren't any safer today than we were 20 years ago when DUI was a nominal offense, with the levels at .12 and .16. Return to those levels, and get rid of the hundred other new big brother driving laws.

All the police and politicians are doing is creating criminals to support revenue thirst.

Cool! According to that calculator, I can drink 6 beers in an hour and still be under .08. But then, I am kind of a big guy.

A commercial license in California the legal limit is .04 and so is it nationally for pilots and has been for many years..

Yep.

I learned that one day when I hit a deer and decided to be a law abiding citizen and contact the sheriff’s dept for permission to take the deer home. the sheriff came out and tagged the deer for me and then said he had to write me a ticket because of the damage to my car, and then explained how the law worked. i convinced him my car was worth less than the threshold dollar amount and he decided to let it go.

I had this “conversation” with a friend following a collision I had with a deer a year and a half ago. I did some research on this subject. I can’t speak for all states, but in CA it isn’t an automatic ticket for a vehicle collision with an animal. It is also not an automatic ticket when an act of nature occurs (e.g., a large rock rolling down a steep rocky hill directly in front of your vehicle while traveling at below the posted highway speed in inclement weather - which severly impacts the vehicles ability to stop and it’s too dangerous to swerve to avoid the rock).
