Election Board: Emanuel Will Remain on Ballot

Burt Odelson, the main attorney for those objecting to Emanuel’s residency, immediately challenged the decision by filing an emergency request for an expedited hearing with the Cook County Circuit Court.

He said state law requires a “physical presence’’ in the city for the year before the election; the only exception to the law is for those who leave for military service.

But Judge Mark Ballard, who received the emergency request, said he saw no reason to compel Emanuel’s lawyers to have to work over the Christmas weekend and compile a response to Odelson’s filing by Monday, as Odelson asked. Instead, Ballard set a hearing for noon on Tuesday. At that point, most of the 30 other objectors who participated in the residency challenge will likely have also filed their appeals to the court, and their cases could be consolidated with Odelson’s.

Odelson implied that Thursday’s elections board ruling had political undertones: he said in previous cases he’s argued before the board under similar circumstances, candidates have been thrown off the ballot.

“The difference is the candidate,’’ Odelson said.

It seems as if Christmas is important to Progressives only if it suits their agenda, otherwise not so much.

I figured he would remain on the ballot from the first mention of this hearing.

A forgone conclusion.

well, the people of Chicago will make the final call.

I will not venture a guess on that one though. Would be nice if a Chicago Freeper would ‘analyze’ this up coming election for us thought.

Obama doesn’t need to be eligible to serve as POTUS, so why should Emanuel need to follow the rules for an insignificant job like Mayor of Chicago?

The sad thing is, as bad as Rahm is, he’s the best candidate running. The hispanic candidate, Gerry Chico is a bigger crook than Rahm and Daley put together. Congressman Danny Davis is a black lifelong pol whose only qualifications to be mayor are- he’s black and he has a beautiful speaking voice. Rev Meeks is a total imbecile who made an announcement last week that only blacks should get affirmative action city contracts. It took him two tries to walk back his comments and he still couldn’t do it right. He’ll be gone soon. Then, of course, there’s Carol Mosely Braun- former U.S Senator, Medicare cheat and pal of African dictators. She didn’t age well, either. With those choices, I’m afraid Rahm is the best bet.

I know this is going to go against the grain here but:
Didn't Emanuel resign from Congress to accept a job as the president's Chief of Staff? If this disqualifies Emanuel from running by virtue of his not being able to commute between Chicago and Washington DC, then something is wrong. The House of Representatives is not a real full time job and many Congress Critters go home on weekends and during recess, so they can maintain their residence in their district. Presidential Chief of Staff is a different animal. As the President's right hand man, The Chief of Staff would be on call 24/7. Not allowing him to run would be punishing him for public service.
Flame away folks. That is my opinion.

Not going to flame, but Rick Santorum (who, by law, had to maintain a residence in PA as senator) was attacked mercilessly for daring to presume that his children were also Pennsylvania residents in regard to their schooling.

I guess residency requirements are determined by the R or D after one's name.
