The defense attorney didn’t need the sheriff to suggest the insanity defense; they were way ahead of him. As to jury pools, yes, they can be tainted, but the jury selection process provides a means of filtering that out, if its used effectively by the prosecution. Besides, the “hateful rhetoric” theory may not be a wise defense because it would justify discovery and a full airing of Loghner’s leftism, and could point to a hate crime directed against Gifford for her being too conservative, and that’ll never fly. The hate crime probably is in play, especially with the fed involved, as that was the whole point of the hate crime legislation, to draw fed resources into local crimes where hate crimes are involved. Or they could be going after Loughner’s alleged racist links. Time will tell.

I think people such as yourself need to remember when you are so intent on blaming what voters have said as the cause for this tragedy, why not mention the rhetoric from Democrat politicians and liberal talking heads including:
President Obama:
“If they bring a knife to the fight, we bring a gun,” Obama said in Philadelphia last night. “Because from what I understand, folks in Philly like a good brawl. I’ve seen Eagles fans.”
And “I need you to go out and talk to your friends and talk to your neighbors. I want you to talk to them whether they are independent or whether they are Republican. I want you to argue with them and get in their face.”
Or John Kerry who said on the Bill Maher show: “I could have gone to 1600 Pennsylvania and killed the real bird with one stone.”
Or Howard Dean “I hate the Republicans and everything they stand for…”
and: “This is a struggle between good and evil and we’re the good?”
and “we need to remember that the enemy here is George Bush, not each other.”
Or Senator Chuck Schumer who called a flight attendant a “bitch.”
Or the Florida Democrats who ran an ad calling for the assassination of Donald Rumsfeld

The left would rather give Loughner a defense and see him go free to shoot another Dem pol than lose this opportunity to smear the right. They are that unhinged and that power thirsty.

it looks to me like the sheriff is trying to deflect blame from his office’s ability (or non ability) to protect one of his citizens from a guy who was a known problem...
He needs to shut his fat trap and stop spouting off his personal opinions on the subject. That’s not the job he’s paid to do. If he has credible evidence of people making threats against others, then go arrest them. Otherwise crawl back in your little rat hole.
