CHAMBERSBURG, Pa. A 10-year-old central Pennsylvania girl who allegedly caused a baby's death by violently shaking him and throwing him into a crib was charged with third-degree murder.
The charges filed against the fifth-grader on Friday in Franklin County came after a coroner's inquest into the death of 11-month-old Heath Ryder. The girl was released into the custody of her parents and ordered not to have unsupervised contact with children under 5.
"This is not a kid that has a mental health disorder. She does not have a personality disorder," the girl's attorney, Jason Kutulakis, told The Public Opinion of Chambersburg. "She is not a bad person. She has no history of behavioral problems or school problems."

A judge immediately transferred the girl's case to juvenile court, where records are sealed. Pennsylvania law requires murder charges to be initiated in adult court regardless of the defendant's age, according District Attorney Matthew Fogal, who supported moving the case to juvenile court. The suspect was 9 when the baby was injured.
MY Prayers go out to the family...
So heart breaking.... Prayers all around.
Evil.
Not buying. I think the 56 year old is saving her own hide by blaming the 10 year old
True, at that age she knew exactly what she was doing. My heart breaks for the parents of the little baby.
I agree. I rememebr 48 hours did something about this. It turned out the drunken father did it and blamed the daughter and in the end he ended up in prison for 10 years for armed robbery, they had to exume the corpse to do an autopsy on it. Well now that baby killing psycho is still in prison and there he will remain.
She was 9 when this happened. I doubt she intended to kill the baby. The adult babysitter who was being paid to watch both children should be on trial. What a miserable situation. Prayers for everyone involved or affected!

My first thought too.
Well, she wasn’t giving him a love pat! Of course, she intended serious harm. Evil exists.
Time to strap her into an extra-large sized paint shaker and turn it on.
“This is not a kid that has a mental health disorder. She does not have a personality disorder,”
It is the long term legacy of the “Great Society” and the short term legacy from when Clinton got away with perjury and and MTV dominated cable. An entire generation of bad parents — leads to a society filled with bad kids.
Hold on for a minute. All we know is what we’ve read. The facts may be completely different. There’s the possibility that the babysitter may be involved.
I can picture Dottie. She probably weighs close to 300 lbs and waddles her way around. Annoyed as hell at little Heath Ryder for wanting a cookie or something in the middle of The View. It’s 1 thing to pick up a year old but you need quite a bit of strength to shake it violently in a protracted fashion which this was. Was the 9 year old girl strong enough/physically large enough? I’m not convinced.
Disgusting.
Perhaps she treated the baby like she has been treated in the past. Maybe she didn’t know any better.
Very true, but whoever committed this horrible act is evil. I pray that the truth will be discovered.
“I pray that the truth will be discovered.”
As do I,something like this is too important to make a mistake.
“This is not a kid that has a mental health disorder. She does not have a personality disorder,” the girl’s attorney, Jason Kutulakis, told The Public Opinion of Chambersburg. “She is not a bad person. She has no history of behavioral problems or school problems.”
Uh, no— she’s just stark raving mad.
But, good luck if a kid dies and the lynch mob is after you!.
Dottie is a skinny older looking woman. I do not understand the 10 year old getting the murder charge.
