We don’t know when he came to realize what was taking place, but we do know that when he was sure of it, he spoke out. He retired in 2001....a long time ago.
If he had opened his mouth while on active duty and said such a thing, it would have been a court-martial offense for comments regarding his commander in chief. He is now a "civilian" like the rest of us and can talk as he likes. BUT, he could actually be brought back on active duty from retirement and court-martialed anyway if Obama and his ilk wanted too do it.
