Trademark board rules against Washington Redskins name

WASHINGTON – The U.S. Patent Office ruled Wednesday that the Washington Redskins nickname is "disparaging of Native Americans" and that the team's federal trademarks for the name must be canceled.

The 2-1 ruling comes after a campaign to change the name has gained momentum over the past year. The team doesn't immediately lose trademark protection and is allowed to retain it during an appeal.

This wouldn’t force the Redskins to change the name, it just means that they couldn’t sue others if they used the Redskins mark in a way that is confusing. But in reality, this might not do much. There is state trademark law and unfair competition that still applies to people who might want to misuse the Redskins mark.

It’s a stinky move, but it doesn’t mean that the Redskins can’t continue to use the mark.

If the Government is going to force the name change of a NFL sports team, shouldn't it take the lead and change the names of some of the military equipment such as the Apache and Black Hawk helicopters? These people in DC are flaming hypocrites.

While there at it, shouldn't they change the name of the state of Indiana, or North and South Dakota. Why stop there, how many towns are named after Native America tribes? How many streets, parks, rivers, mountains have their names rooted in Native American culture. God knows, we can't go on offending the Native Americans, lets just change them all.

I'll just assume you are being deliberately obtuse and having "progressive" fun.
Even Grammar School kids know that "market solutions" are property rights.

National legislation has no rightful role in controlling "market solution" of any kind, except for generally recognized criminal activity, such as Ponzi schemes, pyramid schemes, lobbyists, outright fraud and deceptive business practices.

The subject of this thread is social engineering, plain and simple.

the Massachusetts healthcare law was written, promoted and voted on and passed by Mass legislators for the people of that state. It was not a national law. Nobody is promoting it here.

This goes to a question of motive and the idea that a corrupt, dysfunctional and outright hostile regime using the federal departments in ways they were never designed to achieve an agenda most citizens want no part of. The election in 2012 had consequence and this is one of them. Why oh why can’t you people understand that?
In a perfect world, these federal departments would not be used this way and most would not even exist but guess what, this abuse is what those of us that didn’t have our heads up our butts all predicted and most likely would have prevented if people could have gotten past the fact Mitt was Mormon.

Yes, me again so please stop stalking me until you return with something other than unrelated rhetorical flourishes of the wonders of the days of yore. The thread is on the abuse of power by the executive branch, not whatever the hell that “word salad” (unrelated words strung together) you wrote was.

Problem is poll after poll shows the majority of Americans approve of the name Redskins, and that includes American Indians. There are Indian high schools all over the country with the name of Redskins for the sports teams. They love it as much as any other American.

It would be nice if the wishes of the majority of Americans had any bearing on the actions of the hyper-Leftist bureaucratic shadow-government that Barack Obama has put in place.

When did we get to vote for the Trademark Board? When are the elections for the EPA, or the IRS, or OSHA?

This is no longer government by the consent of the governed, and we have to fight back with all the force and determination we can muster.

Walmart used to have a real good garden hoe but had to paint it a different color. It happened to be black in color and some fruitcake raised cain about it. People were always asking for one of those good black hoes. I’ve still got one.

I think you’re wondering about rappers’ copyright(s) vs. trademark(s). Lyrics would be copyrighted. A logo is trademarked.
