Kentucky warns Noah's Ark theme park over hiring practices

The developer of a Noah's Ark-based theme park in Kentucky said on Wednesday he would fight for his religious rights after state officials warned he could lose millions in potential tax credits if he hires only people who believe in the biblical flood.

Ark Encounter, which is slated to open in 2016 in Williamston, Kentucky, is not hiring anyone yet, but its parent company Answers in Genesis asks employees to sign a faith statement including a belief in creationism and the flood.

Can Starbucks refuse to hire me if I don’t believe coffee is best brewed at 140 degrees but should be brewed at 160?

Is it because Kentucky is trying to promote tourism?

The first amendment prevents (or should prevent) the government from interfering with a person's right to peacefully assemble.

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances

The right to peaceably assemble includes for the purpose of commercial business and also includes the right to not be forced to assemble. This is the same logic applied that and individual can not be forced to support a religion that they do not agree with. In that vein, no business should be forced to assemble with individuals or other businesses that they do not want to be associated with. Therefore, these so called "anti-discrimination" laws are a clear violation of the 1st Amendment.

Yes. IF that Center is seeking special State incentives and tax breaks that only come if an atheist is hired.

There is no right to tax incentives.

If you want the Govt's money, you have to play by the Govt's rules.

No one is forcing anyone to do anything.

State officials and Ark Encounter lawyers have exchanged letters in which the state threatened not to proceed with tax incentives for the park if there was discriminatory hiring practices, a state official confirmed on Wednesday.

Sounds like they are taking public funds for the park.

Although the state hasn’t done anything wrong at this point in time except for being a jerk, please consider the following. If the state does take tax credits from the park for hiring only people who believe in the biblical flood, then the state will be in violation of Section 1 of the 14th Amendment (14A) imo. Section 1 of 14A prohibits the states from making laws / policies which unreasonably abridge the constitutionally enumerated rights of citizens, the 1st Amendment protected freedom of religious expression in this case.

Why should a taxpayer who isn't Christian and who dissagrees with Christian theology have to fund a Christian project?

You know the guys deciding and making these rules are just power hungry bureaucratic aholes who were the strange kids back in school that no one really knew (or cared) who they were. I wouldn’t be disappointed if they disappeared.
