The country may just have voted 52% in favour of leaving the EU, but Brexit wont become a reality unless voted for by members of Parliament, according to Geoffrey Robertson QC.
The lawyer, who set up Doughty Street Chambers, says the referendum was purely advisory, and his sentiments have been echoed by Charles Flint QC in a letter to the Times.
Under our constitution, speaking as a constitutional lawyer, sovereignty rests in what we call the Queen in parliament, Robertson told The Independent.
Its the right of MPs alone to make or break laws, and the peers to block them. So theres no force whatsoever in the referendum result. Its entirely for MPs to decide.
The much spoken about Article 50, the mechanism by which an EU member can leave the union, says a state can only leave the EU in accordance with its own constitutional requirements.
Our most fundamental constitutional requirement is that the decision must be taken by parliament. It will require a bill, said Robertson.
MPs will have to do their duty to vote according to conscience and vote for whats best for Britain. Its a matter for their consciences. They have got to behave courageously and conscientiously.
Democracy in Britain doesnt mean majority rule. Its not the tyranny of the majority or the tyranny of the mob
its the representatives of the people, not the people themselves, who vote for them, he said.

The article brings up a good point.
Actually, I’ve been more expecting France to leave than Britain. After all, they were the ones to vote against the EU Constitution. Not Britain.
Now that the EUnionist have brazenly rolled out the next step in their master plan I wouldn’t be surprised if Frexit gains steam even while the “Europeans” in Britain double down on stupid to stay.
Either that or the EU basically falls apart (too bad, so sad) and something new quickly arises in its place on the back of the Euro.
Seems to me that there were heads on pikes around London after that one failed.
Not a single document as in the U.S.
Trump should call for them to go to Prison.
umm. it’s a freaking constitional monarchy not a republic.
again not a republic it’s a monarchy.
Hey Doughty ... this limey stole your name!
A constitution, but not as you know it....;)
there’s a shortage of Binkies in London apparently. All this fuss over leaving ‘a trade association’.
They only have to blackmail enough to get a majority.
The Conservative party will shortly announce a leadership contest.
This will most likely end in a matchup between Boris Johnson and Theresa May. This contest will be resolved in early September. The result will be decided by Conservative party voters.
If/when Boris wins then he will initiate some action (possibly article 50) to leave the EU. There are other possibilities, including negotiating an amendment to the Lisbon treaty.
If May wins then it’s all much more murky. She voted Remain, so who knows if she would carry through the will of the people.
Anyway: that leadership contest is the next vote on BREXIT. If Boris wins, he can just sign article 50 if he wants. He’ll be acting with a clear mandate and having just been elected as party leader on a BREXIT ticket.
Remember: Gordon Brown (aka “Gordon the Leper”) signed us into the Lisbon Treaty by stealth, and there was no referendum or parliamentary vote. This time there HAS been a referendum and Boris will be acting on a clear mandate.
I believe the Queen favored BREXIT, so if Parliament refuses to act in accord with the referendum, she could technically dissolve Parliament.
That being said, it would be extremely slimy to NOT go ahead with Brexit (and I think Brexit is wrong) -- the majority voted to leave and that's what should happen, even if they have buyer's regret)
Now it's "vote your conscience."
It's always "heads I win, tails you lose" with these people.

not as per UK laws
Unless the proles go all Russian revolution and overthrow by mob force, taking weapons as they go along. The military will have to come around to their side.
“Of course we value your opinion. Now sit down and shut up you blithering idiots. Leave the EU, hah!”
I knew it, they will ignore the vote.
I predicted as much more than a month ago, unless people take to the streets they will ignore it.
They seem to have the kind of constitution that our liberals want, one that is ever changing and subject to current whims which are discovered by the learned judiciary.
What the heck?
How dare the guy...
Is nothing sacred these days...

In truth, I have a sentimental connection to the region where my name (ancestors) came from. It’s one reason why I support Britain and Ireland when I can. I have an affinity for Scotland as well.
