FReepers are getting the vapors over everything. Can it really be that so many FReepers with actual knowledge and experience in these sorts of things have moved on?

I noticed with the Republican primaries, when FReepers I had assumed were political activists confessed to having never taken part in anything political except for spending a few minutes a few times a decade voting in general elections. No wonder the country is in trouble.

This is, first and foremost, a public safety issue. Air traffic control requirements needs to be completely immune from politics.

30 years ago I decided that on general principle I would never vote for a democrat. they can be friends but never trusted in any position of authority over people or in the area of governance and law becoouse there moral conviction is very subjective and dependent on how they emotioaly feel rather then thought out as far as the ramifications of the moral conviction.

It's because the title was incorrect. It should have read:

So it is acceptable for the govt to discriminate? The US Constitution purpose is to force govt to act transparently. Sovereign immunity protects elected officials from tortious conduct, not violations of the Consitiution.

Yep.

And the Constitution provides for impeachment and removal of a president or any other federal official. The people and state governments are the actual sovereigns, so they get the final say.

The Founders did recognize the President as Head of State, and so endowed the office with enough of the customary sovereign powers so that a president would have to be taken seriously, at home and abroad.

Some legal notes:

The motion is appropriate.

As an individual, Obama is protected under rex non potest peccare, just as Bush, and virtually every elected official is. Can you imagine W having to defend himself in court against every solider, or family thereof, hurt in Iraq?

The government is probably secure against MONETARY damages as well, although they could well be awarded in a settlement.

As far as litigation to restore the members of the class to the top of the hiring ladder, rex non potest peccare provided no protection for the USG.

All the rest of the article is “crank up the reader” BS, as most “journalism” is today.
