Just shut the damned thing down and be done with it.
This “sovereign immunity” doctrine is nowhere in the Constitution.
The issues are not mutually exclusive.
The EPA will likely not be shut totally down but will be throttled down.
As I look through the vapors that is the political reality.
There were people damaged by the debacle. The solution was offered. Go to Federal court or go to Congress. Congress is the answer. The damage is not unlike those of a severe flood or hurricane. Congress can appoint a commission to sort through the claims and authorize payment.

Perhaps, a tattoo on the forehead of all of those involved would be a good start. At least, keep the visual on their mind every time they use the bathroom.
