“But congress did not pass a bill that cars get 50 MPG. Obama asked EPA to come up win the new(ridiculous) standards. They call it an “agreement”.”

It will make for an interesting law case. The whole hand-it-off to an agency is, in my opinion, unconstitutional. But a regulation is likely to have the force of law regardless of its origin. The standards now are ridiculous. The reason most cars are really too small for Americans has to do with meeting current standards. The reason you can’t buy a car with a bench seat is because some agency decided they wanted your feet directly in front of you in the event of a collision. So, we all sit with our legs practically immobilized for the entire useful life of our car because of that.

The EPA is subject to oversight from congress. Congress does NOT do oversight anymore and kill ridiculous regulations. Congress critters are lawyers and they don't "do" science. It is beneath them.

This is why a citizen legislature was so important. Anyone who lives in the real world knows 50 MPG is ridiculous. You can't legislate scientific breakthroughs and the engineering technology to go along with that.
