I saw someone being interviewed last night who indicated that the ‘bona fide’ relationship exemption was part of the Trump plan to begin with (???)

Roberts is just the latest in a fairly long line of disappointing republican SCOTUS appointments.

But he probably holds the record for the quickest turnaround from someone praised as a constructionist to just another faithless jurist inventing loopholes and ways to fudge the constitution.

So lets hope he is the last to disappoint.

So many people are happy with the parts of the legislation that SCOTUS approved, they lose sight of the fact that the Supremes STILL legislated from their high perch. The law, used by multiple presidents, is very clear cut and has no exemptions unless provided for in the president’s determination.

I agree with him. I said months ago that when Kennedy retires Roberts would become the swing vote. Kennedy took Sandra Day O Connors place as swing voter. I could already see Roberts positioning himself

Under the exception, the ban does not apply to foreign nationals with a “bona fide” relationship with a person or entity in the United States.

Because we can always be certain that any muslim with a “bona fide relationship with a person or entity in the United States" would never break the law or do anything to harm us.

Roberts is a constitutional moderate, Kennedy a liberal. Makes sense that they sometimes agree.

Here, Roberts probably pulled Kennedy away from some outrageous coup attempt by the four whackos that hate the Constitution.

he just voted NOT to protect gun rights in california- He got obamacare through based on a lie (and asinine opinion after the vote), He got gay marriage through I believe- I’d say he’s not in the middle but almost completely liberal now- at least heavily leaning left

Somebody always is the swing vote.

Let say the senate had confirmed Garland. Then he, Garland, would be the swing vote:

Sotomayor - Ginzburg - Kagan - Breyer - GARLAND - Kennedy - Roberts - Alito - Thomas

But, with Gorsuch, the middle is Kennedy (or maybe Roberts) (the prior court, with Scalia would be restored)

Sotomayor - Ginzburg - Kagan - Breyer - KENNEDY - Roberts - Alito - Gorsuch - Thomas

Image that Trump replaces Ginzburg and Kennedy:

Sotomayor - Kagan - Breyer - Roberts - ALITO - Gorsuch - Trump II - Trump III - Thomas

It is possible Alito becomes the swing vote. With a second term, we could have a court looking like this:

Sotomayor - Kagan - Roberts - Alito - GORSUCH - Trump II - Trump III - Trump IV - Trump V

With Gorsuch, or somebody like him, being the swing vote, and nine members of the court being relatively young.
