From 2014 before Trump even chose to run. Accusations against Bergdahl were immediate, the potus had to know, so obama’s words were pro bergdahl.

“Trump’s statements that could reasonably be viewed as interfering in a legal case over which he had great power.”

The circumstance where that argument might prevail is if it is a jury trial. Then, the argument could be made that the entire pool of potential jurers had been tainted by the POTUS’ public statements, making it impossible to impanel an impartial jury.

Even then, it is very difficult to get a mistrial on that basis. Think of all the highly publicized trials that dominated cable news for months, with nearly every politician, scholar and celebrity constantly weighing in with an opinion - and yet they were never thrown out on that basis.

If it was not a jury trial, the argument makes no sense, since the judge can’t claim he was prejudiced by the President’s remarks.

As usual, this is just another example of the left finding fault with anything Trump does or says, and too many on the right going along with it because they are gullible.

If it was a courts-martial, then it was a military officer as military judge. the Army has many military judges who work and are assigned directed from the Army judiciary in Falls Church, VA.
...
Can Mattis fire the judge?

Any outrage from McCain?

Bowe Bergdahl Gets Honorable Discharge; Trump Criticizes Sentence

https://www.nytimes.com/2017/11/03/us/bowe-bergdahl-sentence.html

But no prison time. I agree with the no prison time, I think he should have gotten the firing squad.

It's a betrayal of our Warriors!

Especially on the eve of Veteran's Day. What a horrible signal to America. Worst ruling ever.

Punishment for Desertion as a crime under the UCMJ became watered down under the tenure of Gerald Ford and SEC of Def Rummy and worsened under Carter. Remember as well both signed pardons for it.

Just about anyone who served from the mid 1970's - 1981 knows that many simply walked off for 31 days, went to a different command to turn themselves in, and got at the most two weeks Brig time {usually not though} and then a Less Than Honorable out which has also had it's stigma removed.

I got out in 1980 Honorable separation at my EAOS. No one not one single person has asked to see my DD/214 for a job, loan, or any other thing. As soon as I got out I saw guys I had gone to high school with who had been out two years and a couple of them I had to work with. Only VA has asked to see my DD/214 for benefits and a funeral director asked for it to give it again to the VA for my wife's burial.

This man deserted in time of war and people died due to it. Not even so much as involuntary manslaughter conviction? This was very serious misconduct he didn't just desert on a base in the US in peacetime. Terrorist are free thanks to O'Traitors deal releasing dangerous GITMO prisoners in exchange for him. Not that O'Traitors arm had to be twisted mind you. He was just looking for an excuse to release them any excuse at all. Personally I wish they would have kept him prisoner over there.

Our military is reaching a crisis in many aspects and a return to the UCMJ as the law of the Armed Forces is needed & needs to be enforced. No amount of money in programs will help until discipline including the banishment of high risk behaviors and associations {meaning with Islam} is restored & enforced. That should apply from E-1 up to and including the chair warming princes in the Pentagon and JCOS.

I’m fearful that a crisis war is the only thing that will shake our military out of it’s culture of demoralization.

Mattis might be a knowledgeable general but I wouldn’t trust him. He’s politicized.

I don’t want such a war but weakness and decadence has a way of attracting them.

Trump was speaking truth to power.

We should expect nothing less.

Trump had NOTHING to do with this retard’s behavior, nor the outcome of his (Bo’s) actions.

Let the Judge live with being a traitor to the Constitution (given 0bama’s trade of 5 jihadis for Bergdahl’s worthless a$$).

“Some jag officer. This is such a bad decision”

Keep in mind that sen,. Linda Graham is a jag officer as well. I formerly believed in the military justice system.

I disagree. It is not our President's fault that this judge disregarded the gravity of the situation, the lives destroyed, the gold star families, and the permanent injuries to our warriors. Donald Trump does not own this. The "judge" owns this.

Nance said he was having a “hard time” with prosecutors’ interpretation, noting public confidence in military courts was something he had to consider.

“The member of the public that we are interested in maintaining confidence in the military justice system ... is going to be influenced by context,” he said.

Nance said his interpretation of Trump’s most recent comments was tantamount to the president saying: “I shouldn’t comment on that, but I think everyone knows what I think on Bowe Bergdahl.”

The White House issued a statement Friday that, without mentioning Bergdahl by name, said any military justice case must be “resolved on its own facts.” Prosecutors cited that statement in opposing the latest defense arguments.
