Virginia court tosses out one-vote victory that briefly ended GOP majority in House

A three- judge panel declined to certify the recount of a key House race today, saying that a questionable ballot should be counted in favor of the Republican and tying a race that Democrats had thought they had won by a single vote.

“The court declares there is no winner in this election,” said Circuit Court Judge Bryant L. Sugg, after the judges deliberated for more than two hours.

The court’s decision leaves the race for the 94th District tied at 11,608 votes for each Del. David Yancey, the Republican incumbent, and Shelly Simonds, his Democratic challenger.

And it leaves the balance of power in the state legislature at 49-51, in favor of Republicans - at least for now.

In the case of a tie in a House race, state law says the winner is chosen by lot – essentially, a coin toss, according to Virginia state law.

Article says loser of the coin toss can demand a recount of the votes- again.
Not logical, but may be true.

The Republican won the race by 12 votes. Democrat picked up 13, and now 12 in the recount.

It is in Nevada statute that ties be settled “by lot”. Card draws are a natural form of lot for Nevada. More than a few races have been decided by the card method.

Agree, I don’t see how it can be constitutional for a state to select a legislator by a method of chance. Either the person gets appointed to fill the post on an interim basis, or you have an election with a winner. It’s absurd.

On a happy note, it looks like the Dems will have a tougher time stealing this election. I guess they just stop counting once their person takes the lead. Oops!

Reading into the article I get that this is what happened:

A recount was held and Simonds had 11608 votes to 11607 votes for Yancey. However, one ballot contained a mark for both Simonds and Yancey, but the mark for Simonds was crossed out. This ballot was initially not counted, but Republicans said it was clear that the voter intended to vote for Yancey and the Judge agreed and added the ballot, now making it 11608 votes for each candidate.
