Dissenting judge on panel worries ruling could foster inappropriate political attacks on presidency
A federal appeals court said this week it will appoint a lawyer to argue that former Arizona Sheriff Joe Arpaios contempt of court conviction should remain on his record despite President Trumps pardon.
The 9th U.S. Circuit Court of Appeals said that since the federal Justice Department is supporting both the pardon and Mr. Arpaios request to have his conviction stricken, someone else needs to argue the other side.
Mr. Arpaio argues that the pardon came before he had a chance to appeal his conviction, and even before the federal district judge in the case had a chance to rule on his request that it be set aside. The former Maricopa County sheriffs opponents had said not only should the conviction stand, but the pardon should be deemed invalid because it subverted the justice system.

Accepting a pardon is an admission of guilt.

Where’s congress? Most all the repubs ran on reigning in activist judges. Yet not one of them has said a word about what the judges have been doing to effect a political outcome, laws be damned.
No it isn't. It is an acknowledgement that the Just-Us system is politically driven.
Just dissolve the ninth circus. Problem solved.
This is partially an FU to DJT, and partially about punishing Arpaio despite the pardon by bankrupting him with legal fees. No normal citizen can afford to defend against a special prosecutor.
He did. Now the 9th, and the state of NY, are trying to gut the power the Executive has to grant pardons, and to limit the scope of those pardons.
The left is taking the goalie out of the game:
1. They just flouted, forever, attorney-client privilege. Nothing stopping anyone in power now from simply raiding an attorney’s office and using whatever they find there.
2. Imagine if Bill Clinton lost his ability to pardon Marc Rich, or any of the other lovely people he pardoned.
They either must think they’ll never get back to Penn Ave, or that they think they can just unring the bell once they get back, if they ever do.
Or, they may know what’s coming, they know what will happen, and they are desperate.
and do it ASSP!
