Jury in Bill Cosby's trial asks: What is consent?

The jury in Bill Cosby's indecent assault trial asked a question Wednesday that goes to the heart of the case against the former TV icon: "What is the legal definition of consent?"

The question came around 1 p.m., less than two hours after the 12-person jury began deliberating the case. Cosby is on trial for three counts of aggravated indecent assault.

Montgomery County court Judge Steven O'Neill told the jurors that he could not answer the question.

"The jury will decide what consent means to them," he said.

If you are qualified to be on a jury than a jury consultant no doubt managed to screen you out.

I thought lawyers were only given a certain number of "challenges without cause" (my words).

Lol!....I did not expect to be laughing so much during the Sentencing phase of this trial. This thread is hysterical. There are just too many wicked jokes to be told, or at least thought about. Too many ‘pregnant pauses’ in the flow of logic.

The jurors are supposed to be the judge in this case.

I think they were given the correct instructions.

The problem is he told her exactly what she was taking and it was “to take off the edge.” Hard to argue she didn’t know what she was doing when he HANDED HER THE PILLS, told her that and she still voluntarily took them.

Possibly you are overlooking the element of DRUGGING the women. They may NOT willingly be doing the things you mention.

I agree that we have seen extremes in people not coming out with allegations for years, but I don’t agree that girls/women can always freely extricate themselves from these situations at will.

I read once that a Supreme Court judge (can't recall which one) was once asked to define "pornography".I think that he responded by saying something like "I can't define it but I know it when I see it".

Well,I can't really define "consent"...but I know it when I see it.

Then there's no way I could vote to convict. The state needs to prove a rape was committed as Job 1.

Yep, that is right, the average women is cool with someone knocking them out with a drug so they are totally unable to know if they are having sex, or being murdered, or being disfigured. Evidently, some women enjoy sex while unconscious.

Where did you get the idea the drink was “spiked”? My understanding of other reports is that Cosby openly offered her pills, and she took them willingly. There’s a big difference.

Well,I can't really define "consent"...but I know it when I see it.

What is your confidence level that 12 jurors will all "know" the same thing about the evidence in the Cosby case? Or is that not important?

If the jury is to use "community standards" to decide what constitutes consent, which community is to be the standard? It's not hard to believe that the Hollywood community standards would be different than yours or mine.
